In any event the Company shall not be liable for damages for any mistakes or delays in the transmission or delivery, or for the non-delivery of this sent telegram, as\ncaused by the negligence of its servants or otherwise, beyond fifty times the REPEAT ED telegram rate at which amount this telegram, if\na\nREPEA whether TED telegram. is hereby unless greater value is stated writing hereon at the time the telegram is offered to the Company for transmission,\nand\nan additional sum paid or agreed to be paid based on such value equal to one-tenth of one per cent. thereof.\n3.\nThe Company is hereby made the agent of the sender, without liability, to forward this telegram over the lines of any other company when necessary\nto\nreach\nits\ndestination.\n4. Messages will be delivered free within the established free delivery limits of the terminal office. For delivery at a greater distance\na\nspecial\ncharge\nwill\nbe made to cover the cost of such delivery.\n5.\nNo responsibility regarding messages attaches to this Company until the same are presented and accepted at one of its transmitting offices: and notice if any\ninstructions message regarding it to the Company agent in its said office. Messages sent to the Company' office by private wire or telephone are sent at the\nis sent to such office by one of this Company's messengers he acts as the-agent of the sender for the purpose of delivering the message and any sender's\nrisk\nof errors or failures in such service and all of the terms and conditions herein shall apply to the message throughout.\n6. The Company shall not be liable for damages or statutory penalties in any case where the claim is not presented in writing within sixty days after the\ntelegram is filed with the Company for transmission.\n7. It is agreed that prompt and correct transmission and delivery of this message shall be presumed in any action for recovery of tolla therefor, subject,\nhowever, to rebuttal by competent evidence.\n8.
