Sununu Chief of Staff to the President 1600 Pennsylvania Avenue Washington, DC 20500 Dear Mr. Sununu: The North Carolina Department of Transportation has reviewed the proposed Memorandum of Agreement developed by the Department of the Army and the Environmental Protection Agency concerning the determination of mitigation under the Clean Water Act. The proposed MOA would have an extremely disruptive effect on our state's highway improvement program--an effect that would result in negative economic consequences and reduced levels of safety. My department's principal objection to the proposed agreement is that it establishes a new wetland policy with regard to mitigation without the benefit of input from the public, from affected agencies and parties, or from the President's Domestic Council Policy Task Force. It is our understanding that the Task Force is responsible for setting policy in this area and we further understand that the Office of Management and Budget had requested that no Federal agency set policies on no net loss until the Task Force completed its deliberations. The process employed in the development of the MOA has been badly flawed and, for that reason alone, it should not become effective. Additionally, there are numerous concerns about the agreement that need to be discussed and clarified before it is considered for implementation. A few of these concerns that would effect this department are: 1. The MOA states that mitigation decisions should not be based on characteristics of the proposed project such as need, social value, or the nature or investment objectives of the project sponsor. The MOA does not make allowances for "pipeline" projects which have already gone through considerable planning and coordination requirements thus creating uncertainty and posing undue hardships for all public and private parties concerned with such projects. 3. The MOA states that mitigation shall be based on the values and functions of the aquatic resources that will be affected without specifying how such values and functions are to be determined. Can you imagine the confusion and delays that would result and the time and money that would be wasted waiting for answers to these basic questions? The only effective and proper way to resolve such points is to provide an opportunity for interested parties to formally submit comments concerning them. I am requesting that the MOA not be implemented until it has been subjected to the Federal rulemaking process and agencies have been given sufficient lead time to prepare for its consequences. In addition to considering the weight of our arguments, I would hope that you would consider their source. North Carolina is ranked as one of the nation's leaders in wetlands protection and has demonstrated that it regards wetlands as valuable resources. This department recognized the need to address the protection and management of our wetland resources in 1985 and worked for the development of one of the first major wetland mitigation banks in the United States. Our bank now consists of approximately 1,200 acres of prime bottomland hardwood forest. Also, Governor Martin has endorsed the President's goal to achieve no net loss of the nation's wetlands and supports efforts to restore and create wetlands where feasible to increase the quantity and quality of the nation's resource base. Finally, a legislative study commission and an interagency working group have been established to develop wetlands protection recommendations appropriate to our needs. If we have a problem with the content of the proposed MOA and the process used to develop it, you can be assured that our questions are motivated by the best interests of effective government, and not by any less honorable motives. Since no public comment period was provided, we hope these comments are useful in the Domestic Policy Council's decision on the final form and implementation of the MOA. The interstate natural gas pipeline industry is committed to preserving this country's fragile environment. Preservation of this nation's wetlands is a worthy goal. However, the industry has some questions and concerns about the MOA. It is unclear whether the MOA and the policy it implements will undermine the longstanding and successful nationwide permitting process. With gas playing a greater role in cleaning our nation's air, new construction projects will be necessary. Ambiguity over the MOA and its impact on nationwide permits may delay projects which would bring increased gas supply to the Northeast, for example. The industry's second concern is the distinction between temporary and permanent loss of wetlands. Pipeline construction results in temporary losses in wetlands areas. Vegetation is typically restored in one to three years after consiruction is completed. We believe the definition of no net loss" needs to be more clearly delineated. One week after our meeting, I travelled to Panama and had an opportunity to meet with the Archbishop. Truly, he is a most thoughtful and impressive figure. And members of the local Jewish community confirmed that the Archbishop has been a longstanding friend of the community and a major force in the pursuit of enhanced understanding and friendship between Catholics and Jews. Indeed, his name has become synonymous with the spirit of Nostra Aetate, Vatican Council Il's declaration that spawned a new era in relations between Catholics and Jews. I would like to thank you, therefore, for your most helpful recommendation. In the course of our meeting, the Archbishop indicated that he would be travelling to Washington in early February and expressed an interest in meeting with you to discuss the current situation in his country. After being in touch with Sarah DeCamp in the Office of Public Liaison, I was delighted to learn that a meeting had been arranged for Friday, February 2nd at 2:30 p.m. I should also note that the Panamanian Jewish leaders with whom I met, like the vast majority of other Panamanians, welcomed the American action to oust Noriega and restore democratic rule to their country. They share the view that democratic stabilization and economic recovery go hand-in- hand. We view these delays and the continued deliberations within the Administration with alarm, since a pullback on the MOA would violate The President's campaign commitments and provide strong evidence that the environment plays "second fiddle" to the oil industry's and developers' agendas when the tough decisions must be made. We know that Executive Office of the President staff coordinating the Administration's decision on the MOA met with representatives from Alaska prior to the most recent postponement of the MOA. We too would like to have the opportunity to meet with these staff members to present our position on the MOA. We suggest that such a meeting include, at a minimum, you, Robert Grady from the Office of Management and Budget, and Michael Deland from the Council on Environmental Quality. I was delighted that the President chose Alexandria to make such a statement and to reward the efforts of those dedicated residents who through their weekly sit-ins, are helping to stop the spread of drugs in their neighborhood. My pleasure turned to disappointment, however, when I discovered that our Republican Councilman, Bill Cleveland, escorted the President, but that, as Chairman of the Republican Party in the City, I had neither been notified of the visit nor invited to attend. Upon discussing the matter with Mr. Cleveland, I learned that he had been notified last Friday that Secretary Kemp would be making the appearance, but was instructed not to mention the event to anyone. He did tell me, however, that he was unaware that the President was going to accompany Secretary Kemp until he stepped out of the limousine. The Alexandria Republican Party worked very hard for George Bush in 1988, and that was reflected in the election results. The President received the highest percentage of raw vote of any Republican presidential candidate in Alexandria's history. Additionally, the Alexandria Republican City Committee has been very supportive of Secretary Kemp in his efforts to promote the privatization of public housing. Not only have I written on the subject as party Chairman (see attached), but last spring we sponsored a forum in Alexandria's black community promoting that concept. Among our speakers were Kimi Gray, Robert Woodson, head of the National Commission on Neighborhood Enterprise, and David Caprara, representing Secretary Kemp who could not attend. Our purpose in sponsoring the forum was to promote not only Secretary Notice: Paid for by the Alexandria Republican Campaign Fund (Alexandria Republican City Committee). and not authorized by any candidate. A copy of our report IS filed with the Federal Election Commission and is available for purchase from the Federal Election Commission, Washington, D.C Governor John Sununu January 18, 1990 Page 2 Kemp's program which the President endorses, but also to promote the Republican Party. That our efforts were neither mentioned, nor trumpeted, in Tuesday's meeting was unfortunate. A presidential blessing would have gone a long way in assisting Republican efforts to make inroads in that community. Alexandria is predominantly a Democratic city. It is only through tireless efforts that the Republican Party has been able to grow, attract new members, and elect members of the City Council and state legislature. Quite simply, we need all the help we can get in broadening our party's base. To that end, a visit by the President could have been a real shot in the arm to our efforts, particularly in the black community. As party chairman, I feel personally slighted in having not been notified of the visit nor invited to attend. In my mind that is a political sin of the first degree. President Bush and Lee Atwater have for years placed great emphasis on the importance of grass roots politics. To not involve the local grass roots leadership in a presidential visit is politically unwise, short sighted, and reflects a lack of commitment to detail. The White House political office, so I understand, is charged with making certain that the political details surrounding a presidential visit are carefully attended to. The way the Republican Party in this City was treated in this case suggests that someone in that office was asleep at the switch. As you know, one way to keep grass roots workers motivated is to occasionally provide them access to the candidate or elected official for whom they are working. Even though Alexandria is just across the river from the District, the President rarely appears in our City. To have scheduled an activity such as occurred yesterday without involving the local Party leadership, suggests some lack of commitment to the grass roots organizations that helped elect the President. I do not mean to suggest that the President's visit should have been the occasion for a Republican rally. It would have been very helpful to us, however, to have provided the local party leadership an opportunity to be seen in our community with the President. By limiting the number of people involved, security, which is so important in such circumstances, would not have been compromised. If this letter results in greater attention to detail by your political staff so that in the future, grass roots leaders will not be neglected, it will have served its purpose. The NRCA is an association of over 70 diverse nonprofit conservation organizations all dedicated to the professional management, conservation and protection of the nation's natural resources. As representatives of national and regional conservation organizations, we share the EPA and the Corps' view that the MOA is not new policy but is "a procedural document that clarifies the existing permit-review process to ensure compliance with the Section 404 (b)(1) Guidelines of the Clean Water Act." The MOA -- a product of interagency negotiations which span years articulates a uniform and consistent policy and, ironically, responds to one of industry's biggest complaints regarding wetlands regulation: lack of predictability in the per- mit review process. Opponents of the MOA claim it will stymie economic activity in Alaska and thus the State should be exempted from the MOA. These arguments are flawed. First, because the MOA clearly allows for flexible and rational application of mitigation in Alaska, economic activity will not be hamstrung. Second, the State's own wetlands resource managers have adopted the "sequential" mitigation policy set out in the MOA as a workable approach to achieving "no net loss of wetlands" in Alaska and, in fact, argue that "The state's current position is to en- courage others to work within that framework, rather than seek an exemption for Alaska." Mr. President, this is a national issue that has national implications and is not confined simply to Alaska. How you resolve this controversy in the days ahead will be a major test of your commitment to wetlands protection. Choosing to revoke, modify, or even delay the MOA beyond January 15, 1990 will indicate to us the end of any real effort by your Administration to deliver on its repeated pledge of "no net loss of wetlands." I write as a Trustee of the Jackson Laboratory in Bar Harbor, Maine. As you know, the lab is one of the premier sites worldwide for genetic research. In addition to their own research activities, however, they are also the most significant breeding facility for mice in the world. They have developed over 1700 strains used in research valued at $600-700 mil- lion. There are perhaps 20 strains available commercially. Last year, the lab suffered a devastating fire in the production facility. Fortunately, they have protected the ability to reproduce the strains through modern reproductive techniques. The ability to make the mice available to the research community was virtually halted, however. In this past year, they have been able to restore a modest production effort, but need $25 million to complete the project. With substantial scientific community support, NIH has been authorized to expend $25 million over the next two years on a genetic research production facility (competitively awarded) for which Jackson Lab is the only logical contender. Some Congressmen, however, in their inevitable wisdom, appear to be trying to split the authorization with part to be used for pork rather than mice. Secretary Sullivan, we believe, is supportive of the laboratory and its efforts. A word to him, however, would be most timely in support of maintaining the original purpose of this authorization. He is obviously under some political pressure. The decision will likely be made in the next few days. Harvard University strongly supports the construction of this network, a high speed, high quality network, which will support research and instruction, enhance national competitiveness, and improve national productivity. In recent years, the United States has lost much of the international lead we have had in networking technology, due in part to an inadequate level of funding for networking research. It is critical that the Office of Science and Technology Policy recommendations for a five year, $400 million networking research program be adopted. The federal government has played a critical role in financing research networks and should continue to do so. The $400 million allocated to the NREN over a period of five years is a very small amount when compared to the total funds spent by government, higher education, and industry on networking technology and services over a similar period. The proposed $400 million will be highly leveraged and will provide substantial new networking capabilities to many people who have not benefited in the past. Many institutions do not have the funds or mid-level networks to connect themselves to the existing NREN network. With this support, not only will more institutions gain access, but also valuable research resources will be made available over the network. Examples of these resources are academic libraries, medical information, and scientific databases which might include weather data, census data, economic data, and environmental data remotely sensed via satellite. The existing national networks are already an important part of the educational infrastructure. Harvard currently uses the four major networks: the Defense Research Internet sponsored by DARPA, the National Science Foundation Network (NSFnet), the Energy Science Network sponsored by the Department of Energy, and (617) 495 3240 or [email protected] the NASA Science Internet. Listed below are several of the major benefits Harvard achieves through its use of the Internet and the NSFnet, a network established five years ago by the National Science Foundation to provide connectivity to the university community with particular emphasis on science and engineering: 1. NSFnet and the Internet provide electronic connection to faculty members at other institutions (in New England, in the nation, and throughout the world) which facilitates collaboration, discussion, and the generation of new ideas. 2. By using the network, members of the Harvard Community may share in the use of scarce or expensive resources such as the national supercomputer centers. 3. The network improves the climate for academic innovation by facilitating information dissemination for current research and by providing access to network-based resources such as libraries, databases, software, and other information technology based services.
