Also, in regard to our discussion on the creation of a volunteer reserve border patrol force as an auxiliary to the existing Immigration and Naturalization Service (INS) Border Patrol, I am urging the support of the Administration in the enactment of legislation. It is anticipated that Representative Carlos Moorhead will sponsor a bill to establish the Border Patrol Volunteer Program in the INS. The program-would be modeled after Los Angeles County's highly successful and cost-effective Sheriff's Reserve Program, and would allow volunteers to assist with routine, non-operational functions, otherwise performed by INS border patrol agents also engaged in critical border patrol law enforcement activities. Functions performed by volunteers could include: assisting in search and rescue missions, providing language interpreter services, observing activities along the border and providing assistance in the Chaplain Program. Volunteers would not be authorized to arrest, detain or interrogate individuals or to engage in any other law enforcement activities. In 1989 and 1990, 150 Members of Congress strongly urged the EPA to regulate the wood preserving industry by using an integrated, multi-statute approach. EPA chose to ignore this Congressional direction and promulgated a cost-ineffective, RCRA-only regulation. I urge you to request Mr. Reilly, EPA Administrator, to continue discussions with the wood preserving industry in order to achieve a more cost effective regulation. The wood preserving industry is not opposed to increased industry regulation. However, compliance expenditures for the EPA listings regulation could be as high as $5 billion exceeding by twice the estimated net value of the industry. This regulation will result in plant closures, due to insufficient capital, unless EPA develops more realistic and cost effective requirements. In addition, I would like to draw your attention to the six month compliance period. Realistically, most plants will need between twelve and eighteen months to upgrade their process area containment systems. EPA has been told of the potential economic harm that could result from its actions and has acknowledged that some of the rule's negative effects were not intended. As you are well aware, I have dedicated my life work here in Washington to gain the freedom of the Sikh nation from the oppression of the Indian government. Mr. Sununu, the Sikh nation today stands at a crucial crossroads and we need the urgent help of the Bush administration. Last week in Khalistan, a Brigadier of the Indian army informed the sarpanches (mayors) from six Sikh villages that if the activity of Sikh freedom fighters is detected in their respective villages, the army will "blow their heads off," kill their youth, confine their woman to army camps, and "breed a new race." Mr. Sununu, no more evidence is needed. I have long pleaded with the international community to take heed of the Indian government's preparation for the genocide of the Sikh nation. Now India has made its intentions clear and the America and the world at large cannot allow such sadistic oppression to stand. The Sikh nation is founded on the principles of freedom and justice for all, and even the thought of such a twisted, savage scheme to destroy the Sikh nation is deplorable. By the very tenets of our religion, every Sikh is obligated fight tyranny and oppression at all costs. As a nation firmly dedicated to the same just principles of freedom, justice and democracy, America must come to the aid of the Sikh nation. Because of our common values, Sikhs are America's strongest, most loyal allies in South Asia. Recall that despite our disheveled condition under Indian government occupation, we offered to send Sikh doctors to the Saudi Desert to aid the effort against the aggression of Saddam Hussein. Sikh-Americans especially showed their support for the Gulf war. On February 9, 1991, hundreds of Sikhs rallied outside the United Nations building in New York to show support for your administration and our brave armed forces in the Persian Gulf. India, on the other hand, is not ally of the United States. It never has been and has never shown any inclination to be an ally. Over the last decade, India has voted against American interests in the United Nations 93% of the time--more often than the Soviet Union! And remember that throughout the Gulf War, India aided Saddam Hussein moth materially and diplomatically. The Indian government even refused to allow unarmed American ieling zone. participating in Operation Desert Storm to use Bombay as Mr. Sununu, this nation's leadership and complete success in che Persian Gulf war has proven to the international community that America is the undisputed sole superpower in the world today. This is a comforting thought considering this nations commitment to freedom worldwide. We are entering a new and exciting era of history. The new world order is upon us and freedom must be the rule not the exception. Our intensive efforts with Israel and the PLO are a natural follow-on to our enforcement of the 12 U.N. Resolutions which led to our liberation of the nation of Kuwait. Turning attention to the 54 U.N. resolutions opposing the division of the Republic of Cyprus is an appropriate and essential element of our nation's improved image and direction. This simple act of focusing on the implementation of these U.N. resolutions will send very constructive messages to all parties directly and indirectly involved with the Cyprus problem. This issue which has for 16 years injured seriously our relationships with key allies and which has been beyond improvement by the Nixon, Ford, Carter and Reagan Administrations is showing the first steps of movement toward solution. Already the officials of the government of Turkey have changed, since Operation Desert Storm, their policy of staying withdrawn from direct involvement in the solution of the Cyprus problem. In the past they left the issue to Turkish Cypriot hard-liners. Their involvement signals a realization that the new world order and the new United States commitment to the implementation of United Nations resolutions will no longer allow past conduct that used to be deemed acceptable. Sununu Chief of Staff The White House Washington, D.C. 20500 Dear Governor Sununu: In the very near future, the Administration, the Congress, and the public will begin to consider and debate proposed legislation to implement a National Energy Strategy. Undoubtedly, part of this debate will focus on the future role of the natural gas industry in our Nation's long-term energy mix. Gas is a clean and plentiful fuel, and can be used in various energy generating activities. Thus, there appears to be a consensus that gas can, should, and will play an ever expanding role in meeting future energy demand. As you consider gas-related issues, I thought it would be useful to provide some background information on recent Federal Energy Regulatory Commission efforts to promote competition in the natural gas industry. Since coming to the FERC, I have focused considerable time and effort on expediting the overall regulatory process. Nowhere has more attention been paid than toward streamlining the review process for proposals seeking to construct and operate new natural gas pipeline facilities. In my view, some of these efforts have already begun to move the certification process along. Since August 23, 1990, shortly after the Persian Gulf crisis began, the Commission has approved 12 major construction projects with a total potential capacity of 1.8 Bcf per day. This is equivalent to 322,323 barrels of oil per day. These projects will serve customers in New York, New Jersey, Pennsylvania, Massachusetts, Connecticut, New Hampshire, Rhode Island, Virginia, South Carolina, Nebraska, Indiana, Iowa, Washington, Texas, Louisiana and Mississippi. I have attached a table (Table A) summarizing these major projects that the Commission has recently approved. This information includes, among other things, an estimate of potentially displaced fuel oil and miles of related pipeline construction and added capacity. While some believe that the renewed attention on natural gas has materialized only since recent world events, this is not true for the Commission. This enables the applicant to arrange for financing and to initiate contract negotiations at an earlier date. This may also serve the goal of fostering competition by enhancing a pipeline's ability to gain access to new or expanded markets. The preliminary determination order is subject to rehearing and will be acted on at the same time the Commission completes its environmental review. The Commission will then issue a final order resolving all aspects of the application. It must be stressed that the finding in a preliminary determination does not translate into certificate authorization until a final order is considered and issued based on a complete record. Thus, the Commission weighs and balances at a meaningful time in the review process all environmental and non-environmental issues when it considers whether it should issue a certificate authorizing construction and operation of the proposed project. I have also attached a summary of the 13 cases where the Commission has issued preliminary determinations (Table C). Two of these cases -- Delta and Texas Gas with a combined capacity of - 241 MMcf per day -- have been subsequently issued certificates by the Commission. Not including Delta and Texas Gas, these proposals involve potential new pipeline capacity of about 5.2 Bcf per day, or the equivalent of about 936,000 barrels of oil per day. The Commission will move to consider final orders on these certificate proposals as expeditiously as possible. In addition to our actions to expedite review of new pipeline construction proposals, the Commission has initiated a generic and comprehensive review of its pipeline certification procedures (see Notice of Proposed Rulemaking, Docket No. RM90-1-000). This rulemaking has attracted the comments and interest of all segments of the natural gas industry. The input we have reviewed will result in a final rule that further streamlines the regulatory process for reviewing new pipeline proposals. Particular attention is being paid to those parts of the Commission's regulations that relate to environmental review, often the most time-consuming aspect of the certificate process. By adopting environmental rules that place a emphasis on early NEPA compliance, months -- if not years of industry competition by allowing easier entry of natural gas regulatory review time can be eliminated. This will foster the market. The Commission is currently reviewing these into comments and expects to consider the final rule in the very near future. We have also established a regulatory framework for pipeline transportation transactions that provides as much flexibility as possible to all segments of the industry. For example, the Commission's prior notice procedures have resulted in additional transportation of market-responsive gas. Our prior notice procedures allow certain transactions to go forward automatically if no one protests the request following publication in the Federal Register. If a protest is filed, the regulations provide a thirty day period for the parties to resolve the matter. If the protest is withdrawn during this period, the transaction may proceed. If the protest is not withdrawn, the request is treated as an application for authorization under section 7 of the Natural Gas Act. Since October 1988, there have been almost 5,000 prior notice transactions. This increased flexibility provides additional potential for natural gas to fulfill its role in meeting this country's energy needs. In conclusion, the Commission has worked to do its part to promote competition in the gas industry. We have tried and will continue to streamline the regulatory process as much as possible. We have attempted to do this by taking into account and balancing competing concerns. To be sure, much work remains to be done. Some of the proposed legislation you will be considering in the next several months, if enacted, will help the Commission make further improvements. But be assured that we will continue to do everything possible within our current authorities to help the Nation meet its future energy needs in a responsible manner. One junior student from each of the high schools in my Congressional District in Houston is selected by their peers and teachers to visit Washington for a week of in-depth study of the operation of our federal government. This program has been tremendously successful in its twenty-one year existence -- primarily because our nation's leaders have demonstrated a willingness to share their thoughts and insights with these young high school representatives. The purpose of my letter is to ask if you would be able to spend a short time with these young men and women, at a time and place convenient to you, during their upcoming trip to Washington. There will be 27 students participating in this year's program, and they will be here from March 11th - 15th. I know that an opportunity to meet with you would mean a great deal to them. It has been my hope that this exposure will help foster an understanding that our government is accessible -- and to make them feel a greater sense of participation in our democratic process.
