II. BACKGROUND
This is intended to be similar to the meetings you have held
with outside experts on such subjects as the USSR and the
Asia/Pacific. There is thus no formal scenario; rather, the
meeting should provide a good opportunity to talk to some
experienced people about what is going on in the region,
about what Mubarak and Shamir may have on their minds, and
how we might best go about the next phase of our policy.

-- Thank you all for taking the time to come. I look forward
to hearing your views on the Middle East and the peace
process.
-- Let me just say that I think we are at an historic moment.
Palestinians appear more willing to accept Israel; Israelis
appear to understand that the status quo is no longer an
option. Especially valuable to me would be your insights
into how prospects for peace in the Middle East have
changed.
-- If there is opportunity to move forward we will not waste
it. At the same time, we want to proceed realistically with
a policy that can be sustained. I would appreciate your
thinking on what the US might best say and do.
--- As you know, President Mubarak and Prime Minister Shamir
will be here next week. Jordan's King Hussein comes in mid-
April. Your views on their thinking would be valuable.

-- Have a meeting of "the Panel" and that meeting will be at the
White House starting at 8:00 a.m. Monday, the 20th -- a holiday.

much time you can -- I doubt that you have much time available but we
are devoting the day to the issue.

MEMORANDUM FOR WHITE HOUSE STAFF

SUBJECT:
Support of Administration Legislative Programs
This memorandum is intended to alert members of the White House
staff to proscriptions on lobbying activities imposed by federal
law and to provide general guidelines to staff members working in
this area so as to insure compliance with those laws.
Simply stated, the so-called "Anti-Lobbying Act" (18 U.S.C $1913)
prohibits the use of appropriated funds, directly or indirectly,
to pay for "any personal service, advertisement, telegram,
telephone, letter, printed or written matter or other device"
intended to influence a Member of Congress in acting upon
legislation, before or after its introduction. There is also an
appropriation rider, which has appeared in appropriation bills
since 1951, barring the use of appropriated funds for "publicity
or propaganda purposes" designed to support or defeat legislation
pending before Congress.
Interpretations of 18 U.S.C. $1913 by the Department of Justice
make it clear that an employee of the Executive Branch, while
acting in his or her official capacity, may communicate with a
member of Congress for the purpose of providing information or
soliciting that member's support for the Administration's
position on matters before Congress whether or not such contact
is invited and whether or not specific legislation is pending.
Thus, the ordinary and traditional interaction between the
Executive and Legislative Branches is permitted. Likewise, it is
not improper for an Executive Branch employee to provide
legitimate informational background and material to the public in
support of an Administration policy effort.
Problems arise where employees of the Executive Branch become
involved, directly or indirectly, in efforts to induce or
encourage members of the public to lobby members of Congress on
Administration programs or legislation. Unfortunately, the line
separating proper and improper conduct is imprecise and the
propriety of an activity may well depend on each individual
situation. The following comments and examples are intended to
provide general guidance for the more frequently encountered
contacts and activities:
1)
Executive Branch officials may speak freely in meetings
with individuals or groups, at public forums, at news
conferences, and during news interviews, but where these
appearances of personnel become so excessive as to be deemed to
be a publicity campaign, the activity might be challenged. Any
undue degree of direct contact with the private sector by persons
who do not ordinarily engage in such activities is evidence of
prohibited conduct.
2) Appropriated funds should not be used to produce written,
printed or electronic communications for distribution with the
intent to induce members of the public to lobby members of
Congress. For example, an organized mailing to members of the
public initiated by Executive Branch personnel, stating the
Administration's position and asking the recipients to contact
their Senators and Representatives in support of that position
should be avoided. Moreover, asking recipients to contact their
elected representatives should also be avoided in communications
sent in response to inquiries received by the Executive Branch.
However, responses to incoming communications may include
information which responds to the specific inquiries as well as
explanations of the Administration's position on matters of
public policy, including proposed legislation.
Massive distribution by the Executive Branch of unsolicited
copies of a public document, such as the reprint of a public
official's speech or other informational materials, may
raise a question even though the contents are only informational
and do not suggest that the recipients contact members of
Congress. Normal unsolicited distribution of press
releases, public officials' speeches, fact sheets and other
informational materials to persons, because of governmental or
organizational position or expression of interest in the subject
matter, would not ordinarily create a problem. Each such
proposed distribution must be separately judged based on the
purpose and content of the communication and the number and kind
of people who will receive the information.
3) Officials and employees of the Executive Branch may properly
have regular contact with non-governmental organizations which
have among their purposes lobbying members of Congress or
attempting to influence the general public to lobby the Congress.
However, in these dealings, the officials should not or even
appear to dominate the group or use the group as an arm of the
Executive Branch.
(a) Examples of the kinds of activities in which Executive
Branch officials might participate in dealing with
independent outside organizations include:
(i)
exchange information, as long as it is not
privileged;
(ii) make suggestions, respond to or raise particular
inquiries, or discuss the merits of various
legislative strategies and related matters, so
long as the Executive Branch officials do not
suggest organization of grass roots pressure;
(iii) address meetings (non-fundraisers) sponsored by
such organizations;
(iv)
Upon the request of an independent organization
organization: provide to it for reproduction and distribution by the
-- sample copies of documents prepared by
Executive Branch officials (such as press
releases, public officials speeches, fact sheets)
that are otherwise available for public
distribution.
-- letters on specific subjects written
by Executive Branch officials.
(Note that the materials must not suggest that the
recipients contact Members of Congress urging support
of particular positions; also the decision to publish
or distribute any such material must be left to the
independent organization.)
(b) Examples of the kinds of things which Executive Branch
officials should avoid include:
(i)
responsibility for the on-going operation of an
outside organization;
(ii)
requesting that an organization activate its
membership at large to contact members of Congress
on behalf of a legislative proposal;
(iii) gathering information or producing materials
specifically for such an organization which cannot
properly or would not ordinarily be gathered or
produced as part of the official's regular work;
(iv) producing or providing multiple copies of materials
to be distributed by such organizations;
(v)
requesting an organization to prepare or distribute
any materials that suggest directly or indirectly that
the recipients contact members of Congress, or playing
any substantial role in advising an organization
regarding the content of material it may wish to
distribute;
(vi) providing to such organizations lists of or
correspondence from persons who favor or oppose
particular policy positions;
(vii) involvement in fundraising activities by such
organizations (because of the varying forms that
such involvement might take, any involvement should be
discussed in advance, with the Counsel's office).
These legal provisions are not intended to prohibit an on-going
dialogue or interaction between the Executive Branch and the
public in an educational effort to explain Administration
positions, but where that conduct develops into a publicity and
propaganda campaign designed or intended to pressure citizen
groups into contacting Congressional representatives, the
boundary of propriety has been crossed.
18 U.S.C. $1913 is a criminal statute and should be taken
seriously. In addition, any specific allegation against White
House staff members (Level IV and above) for violation of 18
U.S.C. $1913 potentially could trigger the "Special Prosecutors
Act", 28 U.S.C. $591, et seq. The General Accounting Office is
also authorized to undertake audits in this area, and any
disallowed expenditures would have to be borne by the individual
supervising the activity that resulted in the unauthorized use of
government funds.
Because $1913 and the appropriation rider have not often been
interpreted it is difficult to be more specific in setting forth
guidelines. Any difficult factual situation should be brought to
the attention of this office before any action is taken.

Acceptance of Special Commercial Discounts
This memorandum provides guidance for the acceptance of special
commercial discounts by members of the White House staff. It is
a recognized fact that in commercial dealings there are a variety
of special rates and commercial discounts offered to individuals.
These are usually derived from membership in organizations,
occupations, age, etc. They are not granted exclusively to
individuals in public service, nor only to those in the Executive
Branch. However, it is also possible that they may be offered
for an improper motive or the acceptance of them might result in
the appearance of impropriety. The acceptance by a White House
Staff member of any special rate or commercial discount will be
governed by the rules and prohibitions related to the acceptance
of gifts.
The only exceptions to this are when the rate or discount is
offered to all government employees, or when the rate or discount
is offered to a defined class of individuals and the White House
staff member is a member of that class.
Note, however, in the instance where the offer is to a defined
class other than all government employees, an exception does not
apply, and such a rate or discount may not be accepted, under the
following circumstances:
A. if it is offered only to members of the White House
staff;
B. if the person or entity offering the rate or discount
1. has exclusive interests that may be directly
affected by the performance of the employee's
official duties; or
2. has or is seeking business with the White House; or
3. appears to be offering the rate or discount to the
staff member with the hope or expectation of
obtaining an advantage or preferment in dealing
with the United States government for any purpose.
C. if acceptance of the rate or discount would otherwise
adversely affect the public's confidence in the
integrity of the government.
Additionally, particular mention should be made of the practice
of purchasing items from foreign manufacturers and obtaining an
offered discount by virtue of holding a diplomatic or an official
passport. There is nothing per se illegal or unethical in this
practice, whether the item was purchased while abroad or from the
United States, as long as the purchase was consistent with the
manufacturer's offer to the class and was made for personal use
and not for resale. However, as a matter of White House policy,
henceforth no member of the White House staff should avail
himself or herself of an offered discount from a foreign
manufacturer based solely upon the holding of such a passport,
unless such person is out of the country on official business for
a period in excess of thirty (30) days. This policy does not
apply to the use of a passport to purchase items for personal use
at a United States Embassy or for the waiver of any foreign taxes
as provided by law or treaty.
Note further, that a staff member is prohibited from using any
rate or discount related to government service to obtain any item
for the purpose of resale at a profit. Such activity will result
in dismissal from the White House staff, and may also result in
criminal prosecution.
This guidance applies to rates and discounts. It does not preclude
a White House staff member from seeking to negotiate a price
in a commercial setting. In doing so, however, the member must be
mindful that he or she should neither seek nor accept a price
that would be violative of the spirit of this guidance or
otherwise create the appearance of using one's government
position for personal gain.
If you have any questions about the above, or about its application
to a particular special rate or discount, please consult with the
Counsel's office before accepting it.

opposed to the agreement. Knowing what we know about the probable timing on the

Petricioli
Mexican Ambassador to Washington, Gustavo Petricioli, has
requested a brief courtesy call on you as soon as it is
convenient. The call could be 10-15 minutes.
Although he did not mention any specific topic I believe that any
substantive discussion would allude to the drug certification
problem and a possible Bush/Salinas meeting. Being a financial
expert, he might also be interested in any developments on the
debt issue.
I will prepare a paper if you can see him.
RECOMMENDATION
That you receive Ambassador Petricioli for a courtesy call as
soon as it is convenient. I understand your reluctance to see
Ambassadors but you might consider an exception given Mexico's

Invitation to Lunch on March 16
I have been asked by Mr. James W. Bergford, Executive Vice
President of Chase Manhattan Bank, if you would be willing to
meet with the Baker Initiative Committee, a group of inter-
national bankers, for lunch on Thursday, March 16, 1989. I know
that it is a Presidential travel day, but if your schedule
permits, it would be a good opportunity for an informal exchange
of views on the national security dimension of the debt
situation.
The Baker Initiative Committee is a group of senior officers of
some 16 U.S. and foreign commercial banks that meets with no
agenda or minutes once or twice a year to review the debt
situation. Chase Manhattan is hosting the next meeting on
March 16-17 here in Washington (2000 Pennsylvania Ave, NW).
Treasury (David Mulford) has asked that the group meet in mid-
March, I believe as a forum for discussing the outcome of the
Administration's review of the debt strategy. Senior officials
from the Fed, the IMF, and the World Bank will also be meeting
with the group. All sessions are informal.
RECOMMENDATION
That you agree to meet with the Baker Initiative Committee for
lunch on March 16.

Subject: New public position by Chairman Arafat on the Final Status of the
West Bank and Gaza is likely this weekend.
We have just this afternoon learned that Chairman Arafat has taped a
SIXTY-MINUTE segment with Mike Wallace likely to be aired this Sunday, in
which he is reported to endorse the idea of a confederation between three
entities, economic links between them, and a "Marshall Plan" for the area
along the lines that we had discussed with Bassam Abu Sharif in Zurich (see
our letter to you of February 1, 1989). If this report is accurate, Arafat's
position would seem to be converging with that of the Director General of P/M
Shamir's office in the interview of January 6th mentioned in our letter.
We are concerned that the substance of the approach we have been
discussing is now breaking too fast and at too high a level of visibility.
We are also led to wonder if some action might not be taken to
encourage the Israelis to say nothing adverse about the substance of this
approach even if they feel it necessary to reaffirm their refusal to deal with
the PLO.
We have phoned Bill Kirby at NEA who will try to alert Dennis Ross
about the program that is now likely to appear this Sunday. As you may have
heard through your office, before he left for Europe, Dennis had asked us to
come down to see him as soon as he returned, and we have an appointment to see
him on Tuesday, February 21st at 2:30 p.m. We already know that your schedule
is close to impossible around this time due to your impending trip to the Far
East and as a result had previously suggested that we wait to see you after
your return and at your convenience.
The Arafat statement, if it follows expected lines, however is
something we thought should not wait until then but that we should draw to
your immediate attention.

Minister. He has requested an appointment with you to discuss
both EC foreign policy issues and bilateral U.S. .-Spanish
concerns. He will be meeting Secretary Baker and U.S. Trade
Representative Carla Hills, and will be holding a round of
consultations with members of Congress.
This will be the first visit by Ordonez since the grueling re-
negotiation of our base agreement, which was completed last
December. Indeed, the main reason for Ordonez's visit is to
repair the damage done to the relationship by the negotiations.
Prime Minister Gonzales is anxious .to pay an official working
visit to Washington this Spring, a subject that Ordonez will
likely raise with you. We have asked the State Department to
inform Spanish officials that, due to scheduling constraints in
the months ahead, a meeting will not be possible until the latter
half of the year.
We understand that the State Department will be recommending that
Foreign Minister Ordonez pay a courtesy call on the President.
We endorse the idea, and will be forwarding a scheduling proposal
for your consideration once we receive the formal recommendation
from the State Department.

Based on a very nasty meeting today it is clear that Roland Evans
intends to give Richard Haass a rough time and attack the
President's and General Scowcroft's judgement in hiring him. He
also intends to attack John Kelly's appointment as Assistant
Secretary of State for Near Eastern and South Asian Affairs.
Evans entered the meeting with a strong prejudice against
Richard's qualifications (and Kelly's). He grilled Richard
extensively on his experience, travels and writings on the Middle
East and clearly did not hear anything which reversed that
prejudice. Richard handled the grilling with poise and
essentially took the position that the proof will be in the
pudding. Evans did take note of that point and he may give the
Administration a short period of grace, but I wouldn't count on
it.
The only answer that Richard gave about which he and I are
concerned was confirmation of Evans' guess that no one had raised
his Commentary article with him during the interview process.
Evans left the meeting with what, given the preceeding grilling,
and his negative comments about Richard's qualifications, can
only be considered an open threat - talk to me on a regular basis
(in journalistic language that generally means leak to me) or I
will attack (trash) you. Tip O'Neill describes a similar
experience with Evans and Novak in his book. They denied
O'Neill's account. In this instance, despite some indirect
language, both Richard and I came to the exact same conclusion
about the meeting and Evans' purpose.
Roman and I think this is better left alone and not discussed
with Evans even if he tries to pursue it with you. Richard is
aware that this is a cross he is going to have to bear.

him to participate in the Evans-Novak Forum at the Madison Hotel
on April 19th. He said that General Scowcroft is familiar with

Administration officials -- that he wants General Scowcroft to
choose a 30-minute timeframe that will suit his schedule to come.

Israeli Foreign Minister Moshe Arens, who will visit Washington
as Secretary Baker's guest beginning on Monday, March 13, has
asked to meet with you and other senior Administration officials,

I strongly recommend you agree to see Minister Arens. It will be
an extremely timely visit in view of his recent meetings in Cairo

Arab-Israeli Peace Initiatives
1. The Dutch Foreign Minister is sponsoring a foreign
policy institute meeting at the Hague on February 1-3 at which
top PLO people will meet leading Israeli Labor Party representa-
tives, including some Knesset members.
Our International Peace Center has been instrumental in
getting the right people to attend on both sides. We have talked
to the PLO people to ensure the highest representation, short of
Chairman Arafat.
The names of the attendees are attached:
We shall be certain the American press is aware of the
meeting and covers it.
2. The calling of elections in the West Bank and Gaza
is the next most practicable step. The PLO will accept elec-
tions. They tell me they are most concerned as to the openness
and fairness of the elections. I suggested a monitoring group of
U.S. Senators and Congressmen, as was used in the Philippines.
They leaped at this suggestion.
Israel must be pressed to accept these elections. I
believe the PLO can be induced to stop the violence of the
intifada in exchange for open and free elections, with candidates
running under the PLO banner.
This will be discussed at the Hague meeting. The
Israeli group intends to push this issue with the PLO. U. S. in-
volvement is essential if elections are to go forward in the
near-term.
3. I reviewed this matter at lunch on Wednesday with
the Egyptian Ambassador in Washington. He will convey the
above-noted items to Foreign Minister Meguid.

I would like to spend some time with you to review this
subject and to tell you of the essential things we have learned
about the PLO leaders. They continue to call me from Tunis on a
regular basis; they are seeking support and guidance for their
new diplomatic approach.
May I see you on February 10th in Washington or for
breakfast on Saturday, the 11th? I will call your securetary
early in February to confirm a date.

In this process, we support a significant exchange program of
students, professors, congressmen, etc, to the Arab Middle East,
visit Congress regularly to make our views known, and assist Saudi
groups visiting the U.S.
During various phases of this program we have started including
a few U.S. Jewish spokesmen. I am happy to report that those
meetings with Saudi businessmen have been an undiluted success.
We will continue to slowly expand this program as means permit.
You are a better judge than I, but I surmise from my own empirical
experiences that our moderate Jewish friends in Washington and
individuals such as yourself reflect far more accurately mainstream
U.S. Jewish thought today, than someone like Morris Abram (whom I
suspect in actuality represents only a small minority, though
admittedly a very vociferous one).
To the extent that I can claim to represent the views of the U.S.'s
largest expatriate civilian population abroad (50-60,000 U.S.
citizens reside in the Arab Gulf countries), let me close by
encouraging you in your search for peace, based on reality and
common sense in the Middle East.

Staff to the President of Mexico
Jose Cordoba Montoya, President Salinas' Chief of Staff, (and
somewhat equivalent to your position on foreign affairs issues),
has requested an appointment with you for 20-30 minutes on March
8 or during the afternoon of March 9. Cordoba is one of Salinas'
closest personal advisors; he was the man who represented Salinas
during the preparations for the November meeting in Houston
between the two Presidents elects He also did much of Mexico's
negotiating on the $3.5 billion financial package at the end of
1988.
Corboda says he wants to discuss Salinas' plans and programs and
how they will possibly affect the U.S. or be affected by U.S.
policy. He may have an important message from Salinas about the
debt and may also want to discuss a possible Presidential
meeting. He will probably also see the Treasury Department but I
have the impression he will not see the State Department.
RECOMMENDATION

Subject: Presidential Appointment Request: Warren Zimmermann,
Ambassador to Yugoslavia
Warren Zimmermann, our newly appointed Ambassador to
Yugoslavia, is in Washington for consultations prior to his
scheduled March 8 departure for Belgrade. He recently returned
from Vienna where he was Chairman of the U.S. Delegation to the
CSCE Follow-Up Meeting that reached agreement in January after
two years of negotiations. He would welcome the opportunity to
pay a courtesy call on President Bush before departing for
Yugoslavia.
Since Tito broke with Stalin in 1948, an independent,
non-aligned Yugoslavia has served important U.S. interests by
preventing Soviet expansion into the Balkans. In recent years,
the country has been moving steadily toward greater political
and economic freedom and closer ties with the West.
Unfortunately, these changes have not come fast enough to avoid
serious political and economic problems. Today, Yugoslavia is
going through a period of political upheaval and economic
crisis that has generated concern in Washington and among our
NATO allies.
A brief meeting and photo opportunity with President Bush
would demonstrate high-level U.S. interest in Yugoslavia as
Ambassador Zimmermann prepares to assume his duties in Belgrade.

Subject: Appointment Request: Warren Zimmermann, Ambassador
to Yugoslavia
Warren Zimmermann, our newly appointed Ambassador to
Yugoslavia, is in Washington for consultations prior to his
scheduled March 8 departure for Belgrade. He would welcome the
opportunity to discuss U.S. policy with you and Robert Gates
before he leaves for post.
Since Tito broke with Stalin in 1948, an independent,
non-aligned Yugoslavia has served important U.S. interests by
preventing Soviet expansion into the Balkans. In recent years,
the country has been moving steadily toward greater political
and economic freedom and closer ties with the West.
Unfortunately, these changes have not come fast enough to avoid
serious political and economic problems. Today, Yugoslavia is
going through a period of political upheaval and economic
crisis that has generated concern in Washington and among our
NATO allies.
Ambassador Zimmermann has just returned from Vienna, where
he was Chairman of the U.S. Delegation to the CSCE Follow-Up
Meeting that reached agreement in January after two years of
negotiations. He would be happy to discuss the implications of
the Vienna meeting for East-West relations in addition to
discussing our relations with Yugoslavia.

(1) On Defense procurement reform: that we really, really
need it and intend to do it.

Senator Dole's office is sending Talking Points to Fred
McClure -- to be fleshed out a little bit more. Ginny has asked
that a copy be provided to you at the same time.

Suggested Talking Points
Defense Management
Repeated statements by President Bush and Senator Tower
demonstrate commitment to Defense management reform.

After extensive consultation with Senator Tower and his new
management team, President has directed conduct of two
separate but related defense reviews: Defense Management
and Defense Strategy.
The Defense Management Review is now well underway and
involves OSD, JCS, OMB and the NSC. It includes a review of
personnel, organization, the planning process, internal
procedures and government-industry relations.
Senator Pressler has been shown the terms of reference for
the Defense management review.
Stress review, because President Bush and Senator Tower are
committed not to write yet another study, but to develop
specific measures to implement the (mostly common) findings
of earlier studies (such as Packard Commission).
Implementation is the key; Packard reforms were not
implemented.
President, Tower and I are committed to this.
Will take time, but the culture of the building must be
changed.
Do not want just another study but specific measures
for change. President will insist on accountability
and daily attention and will make NSC the watchdog to
make sure change happens.

Tower is in full agreement.

Don Atwood would be pleased to spend as much time as is
needed reviewing Senator Pressler's concerns about
management.
Strategy Review
The second review covers strategy. The Defense Strategy
Review provides for:

an assessment of our current posture,
---
a review of objectives and strategies for the future,
---
recommendations on force structure, including the ICBM
modernization program, and
--
a broad assessment of the role of arms control in our
overall strategy.
The Strategy Review will be done through an interagency
process under the chairmanship of the Department of Defense.
Senator Tower has asked Paul Wolfowitz to chair this review.
Tasking was signed by the President Saturday; the initial
meeting is to be held tomorrow.
B-1 Program
The recent accident at Ellsworth AFB, S.D. is indeed of
concern, and the Air Force is taking action to minimize the
possibility of similar mishaps.
B-1 software and hardware are being improved to handle a
precision instrument landing system (ILS).
In the meantime a precision ground-controlled approach (GCA)
system is being used at B-1 bases in poor weather. This is
in effect at Ellsworth.
The major problem with B-1 is the performance of its
electronic counter-measures (ECM).
Air Force has initiated a core program to make B-1 perform
to is full capacity.
Beyond the core program, the Air Force is proposing a radar
warning indicator to warn the crew of electronic threats
which are not covered by the core program.
The "Core Program" is being paid for with expired funds and
the Congressionally mandated $20.5 billion cap will not be
exceeded by this program.
The Radar Warning Receiver was not part of the original
contract and will require new budget authority for FY 1990 -
1991; this will be above the $20.5 billion.
To review, GCA for improved safety is already in place.
ILS and ECM fixes will proceed apace, and will not be very
costly.
The Administration is committed to these.
Naturally, the Air Force, SAC and Ellsworth AFB officials
will continue to work with Senator Pressler and Rapid City
area officials.

Ambassador el-Reedy called yesterday to request a brief
introductory meeting with you. Among the items on el-Reedy's
agenda are President Mubarak's interest in an early visit to
Washington and the possibility of an advance trip to Washington
in early February by Presidential advisor Osama el-Baz.
During the course of our conversation, el-Reedy also mentioned
that Mubarak had called him yesterday afternoon to say that he
had been "extremely pleased" by President Bush's telephone call.
RECOMMENDATION
