- 11 - Section 16 Section 16(d) would require that the U. S. District Court not intervene to prevent the collection of any tax imposed under Puerto Rican law. It appears to us that such a rule might be unconstitu- tional under article III, § 2 of the United States Constitution where the tax in question violated the Compact between the United States and Puerto Rico. This is because the Compact would be passed in the form of an Act of Congress, and any violation by the Puerto Rican government of the Compact would probably consti- tute a Federal question. The Department of Justice should consider this issue.
