Don Webster in Bill Baroody's shop has invited all of our
Congressional Relations staff to a cocktail hour and a
dinner at Taloe House on March 20 at 6 P.M. The purpose of
the dinner is to meet representatives of the building trade
unions who have indicated to the White House their willingness
to get acquainted and cooperate in some areas. Mr. Georgine
who heads that union, is apparently a very important man in
the AFL-CIO and could be very helpful to us. Max has approved
the invitation and the purpose of this memo is to invite each of
you to attend.

Meeting with House Minority Counsels
Minority Leader John Rhode's chief floor man, Dennis Taylor,
has requested separate meetings with you and top members of
your staff for the purposes of getting acquainted and establishing
lines of responsibility and communication with the minority
counsels of House committees.
Although we recognize the reorganization of your staff is under way,
we have held two recent meetings with this group and would like to
build on the momentum that has been achieved so far in improving
Hill relationships.
We would like to arrange meetings for the Domestic Council and OMB
on successive Friday mornings in the Roosevelt Room as soon as
possible. The general format that has been followed in our meetings
is for the top man to introduce his staff and describe their functions and
how it interrelates with the committees of the House. This is followed
by questions and answers.
Their primary concern is to learn how the Domestic Council and OMB
function and gain a better appreciation of the decision-making process.
Also, these counsels frequently need on-the-spot guidance as to
Administration positions on unexpected amendments after they have
received departmental views cleared through OMB. They are
instructed to go through our staff in such cases, but sometimes we are
unavailable or the subject matter is so complex that they need direct
guidance from a policy-maker.
This project has the blessings of Counsellor Marsh and Mr. Friedersdorf,
who assigned it a high priority.

Bob Hope called me personally, based on a leag-standing family
relationship, to seek assistance in having his son, Tony, and
daughter-in-law, Judith interviewed with a view towards working
in the federal government in Washington. Their residence burned
to the ground recently and they have decided its a good time to
get out of the show business world and try their hand in public service.
I have known Tony and Judy for some time and they both are
exceedingly sharp. Both are attorneys, Judith having worked for
Edward Bennett Williams law firm while Tony was attending
Georgetown University. Both are graduates of Harvard Law
School and I don't think it would be difficult to get strong interest
generated in any number of departments or agencies, or even the
White House itself. Tony will be calling me later today with logistics
of their visit to Washington next week.

The recent intensive activity on the Hill, particularly in reference
to the veto vote, has given rise to Congressional Piticism concern-
ing lobbying practices by the Administration.
In fact, I believe you are aware that the senior Democratic leaders
have charged there have been violations of the Anti-Lobbying Law
by Administration representatives. These violations are not pre-
cisely identified. It is my own view that our people operated within
the law, but I think we need to be constantly alert to the limitations
imposed by the Act.
Accepting the general observation of the ambiguity of the statute
and the confusion as to what is prohibited including lack of definitions,
I am of the view that it would be helpful to pull together a rather
concise discussion paper written in laymen's language, setting
forth dos and don'ts and citing examples of what can and cannot
be done.
It is my observation there are two basic areas of concern. Oneof
these is the limitations imposed upon an official of government, and
the second is limitations that are imposed on an individual lobbying
from the private sector. It is my recollection that the Anti-Lobbying Act
is directed at Federal personnel and that other statutes are aimed at
the private sector, which is also confusing and vague. Speaking from
memory, I think the Corrupt Practices Act may apply to the private
sector and its interpretation may offer guidance to those in Federal
service.

Although I cannot recall the citation, there is a rather exhaustive
and well known article on this subject in a major Law Review. It
is the type of article to which frequent reference has been made,
and may be readily identifiable to some of your staff.
If you could please pull something together, it might even be helpful
to have a meeting with the legislative people and have an orientation
meeting in order to give them a better understanding of the subject.

SUBJECT:
DOT Congressional Relations
Secretary Coleman intends to fill the top CGR slot at DOT
which has now been vacant since last August with Mr. Donald
Dwight, former Lt. Governor of Massachusetts. I have interviewed
Mr. Dwight at the request of Secretary Coleman and although
he is a personable fellow, he has no Capitol Hill experience.
I mentioned this fact as a handicap to both he and Secretary
Coloman but they both believe that Dwight's other qualifications
and past political experience make up for this deficiency.
Senator Brooke called to personally endorse Mr. Dwight last
week but early today Senator Brooke's Administrative Assistant,
Mr. Hardy Nathan, called to state that although the Senator
must publicly endorse Dwight, Nathan commented on a confidential
basis that he felt the candidate was unqualified and probably
would perform poorly.
I talked to Secretary Coleman today and advised him of my
interview and the calls from Senator Brooke and Mr. Nathan.
I told Coleman that I would not object to his hiring Dwight
but had reservations because of his lack of Hill experience
and the call from Nathan.
I have referred a number of qualified candidates to Bill Coleman
and he has interviewed them all and wanted to hire two of them
who ultimately turned the job down.
Bill indicated that he was going forward with the hiring of
Dwight and I do not believe that we should oppose him but

received promptly to correspondence directed to the White House,
including correspondence to the President.
I brought this up at senior staff meeting. I would suggest that a
group of us who are involved hold a meeting on this subject.

We want to hold this meeting the first part of the week. I

The coming recess of the Congress next week with the last minute
rush to complete legislation, together with the President being out
of the country, will place a number of demands on the Congressional
relations staff.
It is essential that we focus now on the critical issues. Where we
feel differences might develop that require a Presidential decision
or his policy guidance it is essential the issues be stated clearly
and precisely. It must be accurately summarized in order that it
can be communicated to the President quickly in such form that
he can address it.
It is my suggestion that you have each of your people come up with
a check list and pull together those issues in both the House and
the Senate which they feel could require Presidential action next
week. If it is expected there will be differences in Conference,
these should be listed.
You might want to have Bob Wolthuis collate this material and
provide it in the form of a summary which I will pass on to
Rumsfeld inasmuch as he may wish to alert appropriate White
House staff to start addressing these areas of Presidential
interest in order to save time.
It would be helpful if we could get this today, but if we can't,
then not later than 10:00 Monday morning.
As'an additional requirement, there should be prepared a summary
of the forth coming legislative week in both Houses which can be
transmitted to the President at the beginning of the day Monday.

Nancy Kennedy advises me that the RNC has agreed to pick up,
retrospectively, the expenses of all of the Sequoia trips that we
were billed for up through the end of July ... but only those that
involved Membersoriented activity. The total bill for all of the
trips was $3,200, of which $2,200 wase for trips involving
Members of Congress.
It is now suggested that, since the RNC will be cutting out
approximately 2/3 of the expenses that were anticipated, it
might be appropriate for you to ask Jim Connor to reconsider
his $20 per couple charge for our own proposed trip.

In reference to meetings of Congressional leaders with the
President, and I am talking principally of formal Leadership
meetings, either bipartisan or partisan, I think it would be
helpful if we have a good set of notes on the subjects that are
discussed and the points or questions that are raised by
individual participants. This would include the replies of
Administration officials.
If you would designate someone from your staff to be a note
taker for these meetings, I believe it would provide us with
a good record.
1 believe under the present procedures the staff representative
who attends a small meeting in the Oval Office or in the Cabinet
Room, where only a limited number of members participate,
is the responsible person for note taking.
These notes should be helpful for future reference should the
President or members of the senior staff want to refer back to
them. I would not envision a distribution of the notes; however,
outside of your office, although I would like to have a copy of
the same.

I would appreciate your House and Senate people making inquiry
about and quietly following. I would like to have a report as to
what they learn. The hearings to which I refer are as follows:
1. The Senate Judiciary Committee on questions that relate
to technological surveillance.
2. The House Armed Services Committee on the subject
of drug experiments in the Army.
3. A Subcommittee of the House Judiciary Committee on
matters relating to lobbying.
Additionally, I want to discuss with you and Bob a highly sensitive
matter that may be the subject of a hearing before the Church
Select Committee next week. It is hoped the hearing will not
be held and I want to discuss with you what might be done in that
regard. In all events, I think it would be helpful for you to be
aware of the question.

Until the Congress adjourns, I believe It would be helpful if we
could send to the President, at the close of business each day,
a daily legislative report.
This report will include significant actions completed during the
day in the House and in the Senate. It should also include a
summary of forthcoming actions expected prior to adjournment.
Asid from the legislative business, there should be included
any special reports or requests of Members which they desire
be relayed to the President. In regard to the latter, I refer to
things which are not routine, but are matters of special and
timely interest.
I think the best way to prepare these is to have Vera and Bill
prepare a summary for their respective Houses and then you
attach a memo setting out other pertinent facts you feel should
be added. I will then send this, with my own memo, to the
President at about 6:00 p.m. our time.
