No. 76-185)\nIn my capacity as charged by the President\nin his Memorandum to the Cabinet of August 26, 1976 (copy\nof Sept ember 22, 1976\nattached), I have neview reviewed the letter from the\nSolititor of the Department 'of the Interior to Assistant\nAttorney General Peter Taft. This letter asks the Department\nof Justice to support the Salish/Kootenai tribe's petition\nfor a writt of certiorari in the above case.\nThe facts of the case, the issues of law theren,\nforIndian trus t rights\nand the consequences of the 9th Circuit's decision if not\nreversed by the Supreme Court, lead me respectfully\nthe United S tates\nto suggest to you that should indeed support the petition.\nThis suggestion is reinforced by the position the\nWhite hHouse and the Departments of Justice and Interior have\nwell and consistently taken for the past six years: that as the\ntrustee for Indian natural resources rights, the United States\nconsequent\nhas she special obligation to speak up to defend these\nrights\nI would be glad to meet with you to discuss this\nquestion, although XXX Solicitor Austin's letter and Mr. Baenen's\nbrief together form a *** competent laying out of these issues.\nThis memorandum has the concurrence of the Counsel\nto the President.\nBHPjr\nFORD\nCC: Mr. Austin\nMr. Taft\nMEMORANDUM FOR THE SOLICITOR GENERAL\nSubject: The Namen Case (Sup.
