Shattuck\nBond, Schoeneck & King\nOne Lincoln Center\nSyracuse, New York 13202\n28 OCT 1976\nDear Mr. Shattuck:\nBy letter to the President dated September 24, 1976, you requested\non behalf of the Oneida Indian Nation of New York that the United\nStates file an action against New York State to recover former\nOneida reservation lands. Your letter was referred to this office\nfor response.\nOn October 13, 1976, this Department requested the Justice Department\nto file an action against New York State to seek a declaration that\ntreaties which were entered into between the State and the Oneida\nTribe without the consent of the United States are void as in viola-\ntion of Federal Law, 25 U.S.C. $177. The lands involved are those\nconfirmed to the Oneidas by the United States in the Treaty with the\nSix Nations entered into on November 17, 1795, 7 Stat. 44, 45. We\nhave also requested that an unspecified amount of money damages for\ntrespass be sought and that New York be ejected from all lands it\nnow presently occupies which are not devoted to a vital public purpose.\nIf money damages are to be sought, an action will have to be filed\nbefore July 18, 1977 to avoid the running of the statute of limitations,\n28 U.S.C. $2415. This Department can only recommend, as it has, that\nan action be filed. Whether an action is filed is a matter within\nthe discretion of the Justice Department.
