This is to confirm information orally furnished to
Mr. Bert Levin, Republic of China Desk, Department of State,
and Mr. Richard Solomon of the National Security Council Staff
on January 29, 1975.

In our memorandum of January 25, 1975 to you on this question, we
recommended that we approach the ROC immediately to ask
and take appropriate remedial action
to prevent such activities in the future. At Tab A is a draft State cable,
which has been cleared with Justice, which instructs Ambassador Unger
to broach this matter with Premier Chiang Ching-kuo (CCK) on February 3.
The principal points of the representation to CCK would be:

That we are confident that the ROC will bring these efforts to a
halt immediately, and will ensure that such illicit activity is not
repeated in the future.
-- That such schemes can do inestimable damage to our relationship,
That we will not prosecute the U.S. citizens involved, and will not
otherwise publicly disclose this incident, in order to save embar-
rassment for both sides.

The representation cannot be made before February 3, because
Ambassador Unger will return to Taipei only on that date,
A related operational aspect of this problem is presented in a letter to
you from FBI Director Kelley (at Tab B) in which he states that at least
two U.S. citizens may have committed prosecutable offenses in the
course of this embroglio.
Kelley also notes that, as a matter of
principle, Justice will not proceed with this prosecution if you, as
Secretary of State, determine that for foreign policy reasons there should
be no prosecution.
We recommend that you advise Mr. Kelley that for foreign policy reasons
we should not proceed to prosecute the U.S. citizens involved.
RECOMMENDATION:
1.
That you approve the attached State cable (Tab A).

Irving I. Refkin is registered with the Munitions
Control Office, Department of State, as Vice-President of
Pacific Ordnance and Electronics Corporation, Long Beach,
California, which company is engaged in the manufacture and
exporting of electronic ordnance and Hydraulic equipment for
submarine systems in operational support of United States
destroyers now owned by the ROC. He is not registered with
the Registration Section of the Department of Justice.
Colitti is not registered with either the Munitions
Control Office, Department of State, or Registration Section
of the Department of Justice.
The Naval Investigative Service has advised the Navy
has had a fraud case against the Pacific Ordnance and Electronics
Corporation; however, Refkin is no longer employed by this
corporation. Refkin is known to the Navy as a "con-artist" with
high level contacts in the United States Navy.
