4911.2 Group 2: All employees who enter on duty in the Federal service subsequent to September 30, 1947 other than in excepted positions, and persons who are applicants for positions in the competitive service. This group in- cludes employees who after September 30, 1947, receive competitive appointment by conversion, transfer, re- appointment, or reinstatement. 02 Generally speaking, the Civil Service Commission will have exclusive jurisdiction over the adjudication of all loyalty questions concerning persons in Group 2. The Commission will notify the agencies of the results of adjudication and of any action to be taken in such cases. .03 This agency will have juriediction over the adjudica- tion of all loyalty questions concerning persons in Group 1 and over all security risk cases. Therefore, all provisions of this order with respect to the activities of the Loyalty- Security Board will apply to those persons in Group 1 and to security risk cases. 4912 - Loyalty Board 4912.1 - Establishment of Loyalty Board .01 There is hereby established a Secretary of Defense Loyalty-Security Board, hereinafter referred to as "the Board", the members of which shall be appointed by the Secretary of Defense. Two members will be appointed from among the employees of the Office of the Secretary of Defense; and one such member will be designated as Chairman, and the other as vice chairman. One member and an alternate will be appointed from among the employees of the Joint Chiefs of Staff and Joint Staff, one member and an alternate from the employees of the Research and Development Board, and one member and an alternate from among the employees of the Munitions Board. .02 The Chairman of the Munitions Board, the Chairman of the Research and Development Board, and the Staff Director of the Joint Chiefs of Staff and the Joint Staff, each will nom- inate to the Secretary of Defense two civilian employees, one to serve as principal member and the other as alternate member. .03 Not less than three members or their alternates, in- cluding the chairman or the vice chairman, may be the Board for any hearing held by or any action taken by the Board; and the decision of a majority of the members serving shall be the decision of the Board.
