Since the enactment of the Atomic Energy Act of 1946, the authority of the Manhattan Project to continue the exercise of many of its important functions pertaining to the development and utilization of atomic energy has been questioned by some of the contractors' legal advisors. Pending the appointment and organization of the Atomic Energy Commission, a reaffirmation of the authority of the War Department and of the Manhattan Engineer District is necessary. I am inclosing a. draft of a memorandum under which you would authorize and direct the War Department and the Manhattan Engineer District to continue the exercise of those functions with which they were vested prior to enactment of the Atomic Energy Act.
