APPENDIX C (Continued) to SERVICTA ASA REGOSDS 1940 Selective Service Bill -- Amendment Providing That Inductees Into Land Forces Shall Serve Only in Western Hemisphere and United States Possessions Date: August 26, 1940. President: Roosevelt. General matter in hand: Selective Service Act (S. 4164; 86 Cong. Res. 10873). Specific proposal: Amendment proposed by Senator Lodge, as follows: "Persons inducted into the land forces of the United States pursuant to this act shall not be employed beyond the limits of the Western Iemisphere except in the Territories and possessions of the United States, including the Philippine Islands. " (p. 10895) Action: Amendment adopted substantially in this form (50 Appendix U.S.C. Annotated 303 (e) ) o Discussion in the Senate: "Mr. LODGE "I have used the language written into the amendment because it is language that has already been acted upon by the Senate, and with all its imperfections, it would pro- hibit the sending of any men to Europe. That, I believe, is of such importance that it overshadows some of the minor defects.' (pp. 10895-6) "Mr. ASHURST o Have we the power to limit the President in such a case? My judgment is that under the Constitution he may send the Navy or the Army anywhere he chooses. It is the business of Congress to raise and support the Army and to provide and maintain a navy. I leave it to the judgment of the Senator, Is it not a fact that when we give or grant to the President an army he is the Commander in Chief and may send them wherever he pleases? Has the Senator reflected on that?
