Dear Mr. President:
I have your letter of January 24, 1946, relative to the
War Department's assumption of the entire financial responsi-
bility for preparing and prosecuting charges of atrocities
and war crimes against the leaders of the European Axis
Powers and major leaders of Japan; such financing to begin
January 1, 1946, from funds available to the War Department
from its current appropriations.
Considering the rescissions apparently contemplated by
the Congress in the Second Supplemental Surplus Appropriation
Rescission Bill, some doubt arises as to the War Department's
ability to finance during the last half of fiscal year 1946,
with the funds left in its appropriations, projects of a size-
able nature for which the War Department has not heretofore
budgeted. However, the necessary steps will be taken to comply
with your instructions within the scope of the funds made
available to the War Department and to the fullest extent
possible consistent with the laws applicable to the expenditure
of such funds.
