Reference your W 99167 and W 98975, I disagree with the Attorney General and Commissioner McNutt. The Philippine Commonwealth is about to assume the status of a republic and I believe the disposition of its collaborationists should While there is no question that the crimes committed were O be primarily regarded as its own national responsibility against both the United States and the Commonwealth, the unalterable fact remains that these men were Filipinos, the incirent involved occurred on Philippine soil and the psychological impression which will result deal primarily with Philippine Public opinion. The racial problem will be an ever growing factor and the priority action of the United States cannot fail to be deeply and accumulatively resented by 2 majority of the Philippine people. In all other liberated countries collaborationists have been released to their respective governments for action. For the United States to try these men therefore would violate international custom and practices. The only possible valid reason to intervene would be the doubt of adequate philippine punishment. Even if this doubt proved legitimate, I still believe that paramount interest in this matter lies with the Filipinos. It was their loyalty, their devotion and their gallantry which contributed so markedly to our success and in my opinion, it would be a churlish act indeed to reciprocate this magnificent performance by an exhibition of superior MC IN 51663 (3 Mar 46) SERVICE 2.3 me.
