WAR DEPARTMENT CLASSIFIED MESSAGE CENTER INCOMING CLEAR MESSAGE page 2. From: CINCAFPAC Tokyo, Japan Nr: Z21383 3 March 1946 national sovereignty on incidents connected therewith, and with full independence only 4 months away. In my belief, the United States in its future relationships with the Far East would have everything to lose and nothing to gain by not trusting the Filipinos to take adequate action in the premises. Technically, you may anticipate the gravest challenge by the Philippine Judicial System under the guidance of its Supreme Court and quite possibly by the entire Philippine Government. I would also anticipate the possibility of dissent by our own Supreme Court. At the close of hostilities, the US Army, which had arrested and held in custody several thousand collaboration- ists in the Philippines, turned them and their ultimate disposition over to the Commonwealth Government when the latter assumed its civil status. The Commonwealth by Legislative Act established a peoples court and a chain OF judicial process to try such cases. This is now proceeding. For the United States to reassert its claim to certain of these individuals would not only reverse its previous action in yielding them to the Commonwealth, but would bring up questions of law which could not fail to result in the greatest possible confusion and friction. I can see every possible disadvantage in becoming embroiled in this way and a certain loss of American prestige resulting therefrom. MC IN 51663 (3 Mar 46) UNCLASSIFIED
