UNCLASSIFIED see m CONFIDENTIAL - SECURITY INFORMATION UNCLASSIF DEPARTMENT OF STATE WASHINGTON October 6, 1952 MEMORANDUM FOR THE PRESIDENT Subject: The Case of the Yugoslav Churchman As I informed you on September 25, pursuant to the message which came to you from Cardinal Stritch as well as the request for interven- tion addressed to me by the Apostolic Delegate, we sent telegrams of inquiry to Ambassador Allen in Belgrade. A reply has now been re- ceived, the substance of which you may wish to pass along to Cardinal Stritch. Father Carlos Gnidovac was tried by the Circuit Court of Novo Mesto and found guilty, on September 13, 1952, of membership in a pro- Nazi organization called the "White Guards" during the war, and of active resistance against the National Liberation Army. Of the twenty alleged organizers and members of the White Guard tried by the Cir- cuit Court, four of them including Carlos Gnidovac and his brother : . Franc were sentenced to death, three were sentenced to fifteen years' imprisonment, twelve to from one to thirteen years of imprisonment and one was acquitted. Ambassador Allen was told by the Yugoslav authorities on September 29, 1952, that although Father Gnidovac had been found guilty of serious war crimes, execution of the sentence against him had not as of that time been carried out because of his age. A formal act of grace had not been signed, but there are indications that the Yugoslav authorities intend to do so. In view of the delicate nature of the relations between the Yugoslav Government and Italy, and the belief of the Yugoslav Government that the Catholic Church and the Vatican are merely organs of the Italian foreign policy, it would be unfortunate if the Yugoslav authorities gained the impression that the United States had acted in this case as the result of pressure from the Catholic Church.
