Chapter VIIJ (Maintenance of International Peace and Security) 21. Paragroph (5) of Section (A) to be amended to read as follows: "(5) At any stage of a dispute of the nature referred to in paragraph (3) above, the Security Council may recom- mend to the parties such procedures or conditions of settlement as appear to it to be just.' 22. Paragraph (6) of Section (A) to be amended, subject to the adcption of the nuendment proposed in paragraph 29 THUMIN below, to read as follews: " (6) In appropriate cases the Security Council shall = SERVICE AND the ensure that the International Court of Justice is invoked in accordance with paragraph (4) of Chapter VII, and in general the Security Council shall avail itself to the maximum extent of the services cf the Court in the settle- - ment of disputes of a legal character, in obtaining advice on legal questions connected with other disputes, end in the ascertainment of disputed facts." 23. After paragraph (6) of Section (A), a new paragroph to be added, as follows (with cunsequential changes): "(7) If the Security Council determines that the contin- - uance of a situation is likely to endangor the maintenance of international peace and security, it sholl have the same powers in relation to that situation as it would have hed if the situation had already given rise to a dispute." 24. Paragraph (1) of Section (B) to be amended to read as follows: 1(1) Should the Security Council deem thet a foilure to settle a dispute in nccordance with the procedures indi- cated in paragraph (3) of Section (A), or in accordence with its reccmmendations mode under paragraph (5) of Section (A), constitutes a threat to the maintenance of international peace and security, it shall, in eccordance with the pur- poses and principles of the United Nations, lay down just terms for the settlement of the ddispute, and take any measures necessary for carrying out that settlement and for maintoining international peace and socurity. 25. After paragraph (2) of Section (B), a now paragraph to be inserted, as follows: " (3) If a situation colling for preventive or enforce- ment action under paragraph (1) or paragraph (2) above has 474 -9- -
