My dear Mr. Latta:
The Congress has enacted H. R. 903, "For the relief of the
estate of Myles Perz."
The purpose of the bill is to pay the sum of $5,861.85 to the
estate of Myles Perz, in full settlement of all claims against the
United States on account of the death of this claimant on January
29, 1944, in Chicago, Illinois, from injuries received when he was
struck by a United States Army vehicle.
On the date in question Mr. Perz, age 24, and who supported
his mother and a brother, age 12, alighted from a north-bound street
car which had stopped at the intersection of Kedzie Avenue and Fill-
more Street, in Chicago. While crossing west in front of the street-
car Mr. Perz was struck by a Government vehicle, operated by a civilian
employee of the War Department on official business, which had passed
to the left of the standing streetcar. As a result of the personal
injuries sustained by him in this accident, Mr. Perz died on February
3, 1944. Medical, hospital, and burial expenses in the amount of
$861.85 were incurred and have been paid by his S urvivors.
There appears to be no question but that the death of this
claimant resulted from the negligence of the Government driver
in passing to the left of a standing streetcar in violation of the
vehicle law of the State of Illinois, and in failing to maintain a
proper lookout for pedestrians alighting from streetcars.
A facsimile of the enrolled enactment has been referred to the
War Department, and its reply, interposing no objection to the ap-
proval of the bill, is attached.
I am authorized by the Director of the Bureau of t he Budget to
recommend that the bill be approved.
