My dear Mr. Latta:
The Congress has enacted H.R. 1072, "For the relief
of Henry R. Butler."
It is the purpose of the bill to pay the sum of $5,000
to Henry R. Butler, of Oakland, California, in full settle-
ment of all claims against the United States for personal
injuries sustained and medical and hospital expenses in-
curred as the result of being struck by a Naw truck, on
October 30, 1943.
On October 30, 1943 a Navy truck, operated by a civ-
ilian employee on official business, was proceeding in a
southerly direction on San Pablo Avenue, Oakland, California,
and approaching its intersection with MacArthur Boulevard.
At the same time the claimant was attempting to cross San
Pablo Avenue within the authorized crosswalk. The claimant
had safely crossed the south bound lane of San Pablo Avenue
when he was struck by the Navy vehicle which was partly over
on the wrong, or north bound, lane of the Avenue. The
claimant states that he did not see the on-coming Navy
vehicle, as his head was turned away, being on the lookout
for cars approaching from the south.
As a result of the accident Mr. Butler, who was 57
years of age, sustained a fracture of the right leg with
extension into the knee joint, a fractured toe, fractures
of three ribs, and lacerations of the webs of all five toes.
The medical evidence indicates that he has a slight perman-
ent disability at the right knee joint and numbness of the
right foot with slight disability.
Mr. Butler was absent from employment for a period
of nine months sustaining loss of wages in the amount of
$1,611 ($2,535 less $924 recovered from an accident insur-
ance policy). He incurred medical and hospital expenses
