dear Mr. Hopkins:
On June 29, 1949, you notified this office that H.R. 3198,
"To amend the Act of June 18, 1929", had been received at the
White House and requested reports and recommendations as to the
approval of the bill.
The act of June 18, 1929 (46 Stat. 21) conferred on the Bureau
of the Census specific authority to employ and utilize the services
of other Government employees, without violating the so-called dual
compensation and hold-other-lucrative-officesstatutes. However,
the language used in that act restricted such authority to the Fif-
teenth Decennial Census and did not extend such authority to sub-
sequent censuses. Inasmuch as other provisions of the act were to
be applicable not only to the Fifteenth Decennial Census but also
to subsequent censuses, it can be assumed that the restrictive na-
ture of this single provision was due to an inadvertent oversight.
The purpose of this enactment, which was initiated by the De-
partment of Commerce, is to amend the Act of June 18, 1929, so as
to remedy the oversight and to provide the Bureau of the Census with
permanent authority to utilize the services of other Government em-
ployees for field work in connection with future decennial censuses.
Facsimiles of the enrolled enactment have been referred to the
Department of Commerce, the Civil Service Commission and the General
Accounting Office and their replies, interposing no objection to
enactment of the measure, are attached.
The Bureau of the Budget recommends that the bill be approved.
