MINORITY REPORT on the LONGORTA INVESTIGATION
I deoply regret the necessity of riling a minority
report in the matter pertaining to alloged discrimination
in the handling of the body of Polix Longoria. I respect
the ability and integrity of each member of the investi-
gating committee. Sincere mon may difforiin the inter-
protation of evidence and their subsequent conclusions.
Is therefore, could not conour in their majority report
w1 thout violating both my sense of justice and my intel-
lectual honeaty.
The duty of this committee was to establish the
accuracy or inaccuracy or conflicting reports alleging
that discrimination had been ahown in the handling of
Pelix Longoria's funeral arrangements.
Mr.
Kennedy,
the
owner of the funeral home at Throe nivers was the only
person who had the opportunity to discriminate, and I
concern myself aololy with his words and actions in re-
lation to alleged discrimination botween January 8, 1949,
through January 11, 1949. The pertinent facts are briefly
these:
on the 8th of January 1949, lites Beatrice Longoria
tried to avail horself of the use of the funeral home
chapel for her husbands funeral. In the testimony ahe
stated that Mr. Kennedy said, "He couldn't do it because
the whites would ob ject to it. Itr. Kennedy stated in
the testimony that he discouraged the use of the chapel
because he fearod trouble betweon mombers of the Longoria
fumily and that his dissouragement had nothing to do with
the racial origin of the decoased. Ho denied tolling
Mrs. Longoria that "White people might object." There is
ovidence in the record that the father and brother of the
deceased were arrosted for fighting with a man in 1947.
Me. Kennedy had heard of this trouble and stated that such
trouble and four of futuro trouble were the aole reasons
for his discouragement of the uso of the chapel.
Mrs. Longoria loft Throe Rivers on January 8, appar-
ently satiafied to hold the funeral services in her home
as suggosted by Kennedy. She proceeded to Corpus
Christi and on January 10, contacted through her sister,
Dr. Hector P. Garcia, President of the Amorican ar Porum,
an organization consisting primarily of Latin American
Voterans. She told Dr. Garcia of the facta and said
that ahe desired the use of the chapel. Dr. Garcia phoned
Mr. Kennedy and so requested it on behalf of Mrs. Longoria.
Mr. Kennedy roplied that he could not do it because "The
whites wouldn't like it." Dr. then called Itr. George
Oroh, a reporter of the Corpus Christs Times, and told him
