TELCON Irwin/Johnson/Kissinger 9:10 am 12/3/70 I: Our concern is the Soviet defector. Today Macomber was asked up to the Hayes Committee on this situation. Eliot has been deferring Kennedy since Monday. We both feel it would be helpful if the reports could be released to the public. What is in State's has been made public. K: By whom? J: The press conference statement made on Monday was constant withthe report. Nobody released this report. K: One sentence dealing with my staff which was highly misledding. J: In what way? K: This happened 36 hours after the event SO it's irrelevant. Nov. 25 after he was returned. Whatever was said was irrelevant and does not constitute WH consultation. JP It didn't say it was. K: My fellow was talking to yours about Berlin access. We have a defector case and my man said good luck. We never made an issue of not being notified after the event so it's not an issue. The concern of the President was the handling of the case to save the defector. No one reading this would realize it was 36 hours after athe event. J: I think it's clear. It's in chronological form. We covered everything. That says there was no notification of NSC STAFF. I: There's no indication to drag you or the NSC into it. or make us look better. K: This came up as peripheral remark. Your fellow didn't even call us. He was asked what else was new. J: There's no -- we aren't trying to justify ourselves. We just sent every fact. K: We don't blame you SO there's no blame attached to post-event procedures. It's neither here nor there. Never heard President mention what happened afterwards. His concern is with the 10 hour period while the fellow was trying to defect. If it comes up in questioning I would appreciate your making clear it happened after the event.
