Telcon Carl Maw/HAK August 16, 1973; 10:17 a. m. K: Hello. M: Good morning, Henry. K: Carl, I've now got that plea they made and I would feel a lot better if you had a chance to look it over. They've already submitted it. M: Right. K: And, see, I think that the trouble is that the counsel to the White House has an interest in protecting the President. M: That's right. K: And the Justice Department has an interest in protecting the FBI. And he's already got a story in the Washington Post today saying that I requested the tap to be put on Halperin. Now I've shown you that letter which makes it clear that I didn't. M: Oh, I don't think I would comment, Henry. K: No, I won't comment, but I wonder whether I should submit a separate plea. M: Well, put that in the mail to me and we'll come back to you. K: Well, you see the facts are that this was ordered by the President in a meeting in his office which Hoover and Mitchell attended, and my role in the Halperin tap was really nothing. Now, I don't have to go as far as that. Technically, I didn't even give his name. M; Yeah. K: Didn't even give his name for investigation. M: How did they get his name? K: Because Halperin was on their list to begin with. They had refused to clear him. M: How did they get the others? Did you give any names?
