Kissinger HK SUBJECT: Question and Answer on Restrictive Amendments Proposed by Senators Cooper and Church I have just been informed by Bill Timmons that Senators Cooper and Church have proposed an amendment to the Foreign Military Sales Act designed to prohibit your ability to offer further military assistance to Cambodia. We have hastily staffed this with the departments this afternoon and all agree that it will be necessary for you to oppose it as an unnecessary restriction on your Constitutional authority as Commander-in-Chief. It is possible that your position on the Cooper-Church amendment may be raised at this evening's press conference. Rather than coming out directly in opposition at the conference we suggest the interim response at Tab A. This response will provide us with more time to carefully staff the implications of the amend- ment and at the same time avoid a direct confrontation with its supporters in the public media at this particular point in time. At Tab B is a copy of the Cooper-Church amendment. At Tab C is a copy of Senator Cooper's statement of May 7 supporting the amendment.
