Today's Schedule: There will not be a Cabinet meeting at 1:00 Duberstein today. Also, there will be no photo op. During the GOP Leader- ship Meeting, the VP and Shultz will brief on their trips, and Khedouri will brief on jobs proposals. 2. Tomorrow's Schedule: A news conference will be held tomorrow Gergen night, and will be announced today. Guidance re Tower visit is that he will discuss defense in general, and also the Munich conference. 3. Economic Figures: Industrial production figures will be released Feldstein tomorrow; housing starts and personal income will be out on Fri- day. It was also noted that inventory figures have dropped recently. 4. EPA: Two separate hearings will be held today at which Gorsuch, Perry, and perhaps Daniel will testify. Guidance will be formu- lated re allegations by Kaufman. Regarding network news story on Missouri dioxin problem, comments Speakes will be left with FEMA and EPA. It is important to note that we will continue to take all necessary precautions to protect public health. 5. Jobs Bill: We will probably not receive a formal response from Speakes House Democrats until tomorrow, and should not comment on details. Duberstein 6. Social Security: Greenspan is testifying on this in the Senate Duberstein today; no problems are anticipated. 7. HHS Parental Notification Rule: HHS and DOJ are working on guid- Fuller ance regarding court order enjoining enforcement of the rule. We Speakes should be sure to stress the family responsibility aspects of the rule in any comments. 8. Rail Strike: An executive order was signed last night halting the Darman strike for at least 60 days. Fuller 9. Foreign Policy Speech: A second draft is now being discussed. The Gergen speech is tentatively set for February 22 before the American Clark Legion. 10. Legislative Calendar: It was noted that Alice Rivlin will testify Duberstein today before the Senate Budget Committee; Secretary Shultz will testify regarding the world economic situation; and Feldstein and Regan will both testify before the Senate Appropriations Committee. Today's Schedule: Congressional meetings this afternoon will Duberstein discuss CBI and tuition tax credits. On CBI, we are releasing a statement saying that legislation will follow (probably tomor- row) ; Enders will be available for questions. On tuition tax credits, a statement will be released and the bill will be for- warded today; Gary Jones will be available for questions. Also, the support coalition on tuition tax credits will be in at 3:00 for a meeting (the President will not attend). 2. Press Conference: Guidance on EPA was circulated for comment Gergen last night; prompt response is requested. Guidance is still Darman needed on the Hatfield proposal and elements of our jobs bill. Wright 3. Arms Control: With regard to the story by Michael Getler, it Allin was reiterated that there is no recommendation from the VP awaiting decision by the President. Also, while the West German elections are a factor in our thinking, they are not a determinant. 4. Tomorrow's Schedule: The President's lunch with the VP is a Speakes tentative photo op. 5. EPA Executive Privilege Question: Guidance is that, as the Presi- Speakes dent said, executive privilege will not be used to cover up alle- gations of wrongdoing; we will continue to work with the Hill on a compromise as recommended by one district court. Regarding the question of relocating residents of Times Beach, Mis- Speakes souri, we have no comment at this time. 8. Today's Schedule: Photo ops will be held during Willoch meeting and Speakes departure. Also, the ACU speech will be covered by the press. 2. USDA Civil Rights Memo: Fuller has received a report from USDA; the Fuller agency is looking into the matter further. 3. ACU Speech: Draft has been reviewed by the President, and his changes Gergen are now being made in the speech. It was suggested that senior staff Darman closely review the speech. It was also noted that Shultz, Weinberger, Hodel and Regan will all be speaking to ACU before the President. 4. Radio Speech: A draft (on the defense budget) has already gone in to Gergen the President Darman 5. Senior Staff: There will be no senior staff meeting on Monday, February 21, due to the federal holiday. 6. Tuesday's Schedule: A photo op will probably be held during the meeting Speakes with PM Seaga, and the speech to the American Legion will receive press coverage. 7. Libya/Sudan: NSC has provided guidance to the press office on this; Speakes no remarks that go beyond the guidance should be made unless first Allin cleared by the NSC. It was also stressed that the President's comments on this subject at his press conference were completely accurate. 8. EPA Documents: A meeting with Congress has been set up for today. Fielding 9. School Prayer: A decision should be made on when the package is sent Duberstein to the Hill. Porter 10. Personal Income: Figures were flat in January; this is difficult to Feldstein analyze without looking at the January CPI figures. 11. Adelman Nomination: An all-out effort will be made. This will be Duberstein coordinated by Duberstein, who will work with Ken Dam and Powell Moore. 12. Foreign Policy Speech: This needs to be circulated quickly, and then Gergen will be forwarded to the President today or tomorrow. Darman 13. Federalism: OMB is attempting to resolve some agency concerns on this Wright package, which will then be circulated for comment. Williamson 14. Health Care Initiatives: OMB is discussing this package with HHS and Duberstein should be finished today. There is a need to transmit this to the Hill Wright quickly; decision is to aim for next Tuesday. 15. Boyden Gray CBG RE: 504 Handicapped Regulations Brad Reynolds is determined to publish and hold a series of hearings on proposed changes to the 504 handicapped regulations notwithstanding (1) the potential public backlash from handicap groups, and (2) the likely absence of any public support from any other sector. It is difficult to assess how much adverse publicity the proposals will generate. Reynolds believes the changes themselves do not justify broad protest, and he is undoubtedly correct as a matter of law. But the handicap groups will use the 504 hearings as a forum for attacking the Administration on a number of related issues over which Reynolds has no control, such as 94-142 (Secretary Bell's controversial handicapped education rules), the Grove City case, "Baby Doe," and OMB Circular A-122. (The 94-142 groups have been sufficiently vocal to stop White House efforts to block-grant 94-142 for two years.) It is also difficult to predict how little support there will be. But the major, big dollar-saving reforms have already been achieved at the agency level and in court (in transportation and construction), and the proposed changes will not as a practical matter do much more than make the rules more readable and understandable. Accordingly, while OMB, OPD and OVP approve of the proposals as a matter of law and policy, they all believe that the issues raised by the proposals are predominantly political and that a decision on whether to go forward with the proposals is a political one. (It should be added that unlike most organized minority groups, the handicapped are not predominantly attached to the Democratic party and tend to support Republicans more than Democrats; the pro-life groups are, of course, strong Administration supporters.) Congressman Michel, who is strongly opposed to the changes, is prepared to call the Attorney General or Reynolds if the White House will not undercut him.
