The President today announced his intention to appoint James Bopp,
Jr., to be a Member of the President's Committee on Mental
Retardation for a term expiring May 11, 1987. He will succeed
Vicki Marie Click.
Mr. Bopp is an attorney with the firm of Brames, Bopp & Haynes in
Terre Haute, Indiana. He served as Special Deputy Prosecutor for
the Marion County Prosecutor's Office in 1977-1979; Instructor of
Commercial Law at Indiana University School of Business in
1977-1978; and Deputy Attorney General for the State of Indiana in
1973-1975.
He graduated from Indiana University (B.A., 1970) and the
University of Florida College of Law in 1973. He is married and
resides in Terre Haute, Indiana. He was born February 8, 1948 in
Terre Haute.

The President today announced his intention to appoint John F.W.
Rogers to be a Member of the Advisory Council on Historic
Preservation. He will succeed Gerald P. Carmen.
Mr. Rogers is currently Assistant to the President for Management
and Administration and Director of the Office of Administration.
He joined the White House Staff in January 1981 and has
responsibility for the Administrative operations of the White House
and the Executive Office of the President.
Before joining the White House Staff, Mr. Rogers was Special
Assistant for Administration at the American Enterprise Institute
of Public Policy Research (AEI) and prior to that worked at the
U.S. Senate and the White House during the Ford Administration.
Mr. Rogers is a graduate of the George Washington University and
recipient of the Trautman Scholarship. He represents the President
on the Board of Trustees of the U.S. Capitol Historic Society and
is a member of the Board of the National Building Museum. He was
born in Seneca Falls, New York on April 15, 1956.

National Commission on Space
I advised Jim Muncy of the Office of Science and Technology
Policy (OSTP) that it will be necessary to issue an
executive order to comply with the directive in Section
203 (a) of Public Law 98-361, 98 Stat. 422, 428 (July 16,
1984) that the President "within ninety days of the
enactment of this Act establish a National Commission on
Space." Muncy informed me that OSTP had prepared a rough
draft of such an executive order, and I told Muncy that the
draft should be sent to John Cooney so that it could be run
through the normal OMB clearance process for executive
orders.

Prospective Appointment of Mimi Rodden
to the Advisory Council on Historic
Preservation
I have reviewed the Personal Data Statement (PDS) submitted
by Mimi Rodden in connection with her prospective appoint-
ment to the Advisory Council on Historic Preservation.
Under 16 U.S.C. § 470i (a), several members serve on the
Council ex officio and others are appointed by the President.
Mrs. Rodden is to be appointed pursuant to 16 U.S.C.
§ 470i (a) (9), which authorizes the President to appoint
"four experts in the field of historic preservation." Mrs.
Rodden clearly qualifies as such an expert. She is the sole
proprietor of a preservation consulting firm, has been
involved in numerous historic preservation projects, and
served during 1978-1982 as the State Historic Preservation
Officer for Nevada. Mrs. Rodden's PDS reveals no associations
or holdings that would present an obstacle to her appointment,
and I have no objection to proceeding with it.

Reappointment of Virginia J. Thornburgh
to the President's Committee on Mental
Retardation
I have reviewed the Personal Data Statement submitted by
Virginia J. Thornburgh in connection with her prospective
reappointment to the President's Committee on Mental Retar-
dation (PCMR). The PCMR, established by Executive Order
11776, provides advice to the President on mental retarda-
tion, Federal programs in the area, and the development and
dissemination of information on mental retardation. The
PCMR submits an annual report to the President on mental
retardation.
Pursuant to section 2 of Executive Order 11776, several
Cabinet members serve on the Committee ex officio, and the
President may appoint "[n]ot more than twenty-one other
members employed in either the public or the private
sectors
includ[ing] specialists in medicine and other
healing arts, human development, special education, law, and
employment problems, as well as members of foundations and
other private organizations active in the mental retardation
field."
Mrs. Thornburgh, the wife of the Governor of Pennsylvania,
has been an active volunteer in the area of services to the
handicapped. She has a 24-year old retarded son. None of
her financial holdings present any conflicts difficulties
with respect to her reappointment. Mrs. Thornburgh is a
member of the National Organization of Women and an ERA
advocate, but these matters are not likely to affect her
service on the Committee.

I have reviewed the Personal Data Statement submitted by
Deputy Assistant Attorney General Richard Abell in con-
nection with his prospective appointment to the Board of
Directors of the Federal Prison Industries. By virtue of
18 U.S.C. § 4121, the President is authorized to appoint six
individuals to this Board, including a representative of the
Attorney General. Mr. Abell will serve on the Board as the
Attorney General's representative.
Federal Prison Industries is a government corporation of the
District of Columbia charged with administering the prison
industries program of the Federal prison system. Nothing in
Mr. Abell's PDS presents any difficulties with his prospec-
tive appointment; as a Department of Justice employee he is
appropriately situated to represent the Attorney General on
the Board.
I have not yet received a PDS from Joanna C. Maitland, and
advised Presidential Personnel of her delinquency some time
ago.

above-named individual in connection with his prospective

Mr. Silverstein satisfies the only statutory requirement for
trustees, i.e., that they be citizens of the United States.
The duties of the Board consist of maintaining and adminis-
tering the Kennedy Center, and I see nothing that would
preclude the conflict-free discharge of this responsibility
by Mr. Silverstein.
Mr. Silverstein registered as a foreign agent on behalf of
the Netherlands Antilles from 1973 to 1980. Since the
registration has terminated he has no current problem with
18 U.S.C. $ 219, but in light of the obscurity of that
provision and the possibility that Mr. Silverstein might
plan on registering again the future, I took the precaution
of alerting Mr. Silverstein to the prohibition contained in
section 219.

Appointment of Lloyd N. Cutler
to the Commission on Executive,
Legislative, and Judicial Salaries
(the "Quadrennial Commission")
I have reviewed the Personal Data Statement submitted by Mr.
Cutler in connection with his prospective appointment to the
Quadrennial Commission, and have no objection to proceeding
with the appointment. The President is authorized to
appoint three members to the Commission pursuant to 2 U.S.C.
$ 352 (1) (A). The only statutory requirement in the enabling
act is that the Commissioners be "from private life,' a
requirement satisfied in Cutler's case.
As we discussed, Cutler's prospective appointment presented
a problem under 18 U.S.C. $ 219, since Cutler was registered
as a foreign agent. I advised Cutler that he would be
required to terminate his registration (and, of course,
refrain from any activities that would require registration)
during the period of his government service. Cutler agreed
to do so and has in fact terminated his registration (copy
of letter to Justice Department Registration Unit attached).
Cutler serves as a member of the American Bar Association
Commission on Federal Judicial Compensation, but has agreed
to resign to avoid any apparent conflict if appointed to the
Quadrennial Commission.
I have not yet received a completed PDS from Alexander B.
Trowbridge, the other prospective appointee to the Commission,
but he has been contacted and urged to expedite completion
of the form.

to the President's Committee on
Mental Retardation
I have reviewed the Personal Data Statement submitted by the
above-named individual in connection with her prospective
reappointment to the President's Committee on Mental
Retardation (PCMR). The PCMR, established by Executive
Order 11776, provides advice to the President on mental
retardation, Federal programs in the area, and the
development and dissemination of information on mental
retardation. The PCMR submits an annual report to the
President on mental retardation.
Pursuant to section 2 of Executive Order 11776, several
Cabinet members serve on the Committee ex officio, and the
President may appoint "[n]ot more than twenty-one other
members
employed in either the public or the private
sectors
includ[ing] specialists in medicine and other
healing arts, human development, special education, law, and
employment problems, as well as members of foundations and
other private organizations active in the mental retardation
field."
Mrs. Seggerman clearly satisfies the criteria of the Executive

Appointees to National
Commission on Space
I have reviewed the Personal Data Statements submitted by 12
individuals (Jack L. Kerrebrock, George B. Field, David C.
Webb, Lt. General William H. Fitch, Neil A. Armstrong,
Laurel L. Wilkening, Paul J. Coleman, Jr., Luis W. Alvarez,
Charles E. Yeager, Charles M. Herzfeld, Thomas O. Paine,
Kathryn D. Sullivan) in connection with their prospective
appointments to the National Commission on Space. The
Commission was established by Public Law 98-361, 42 U.S.C.
$ 2451 note, to study space activities and formulate an
agenda for the U.S. civilian space program. The Commission
is to submit to the President and Congress a long-range plan
for civilian space activity.
Pursuant to Section 203 (a) (1) of Public Law 98-361, the
President is authorized to appoint 15 members to the Com-
mission "selected from among individuals from Federal,
State, and local governments, industry, business, labor,
academia, and the general population who, by reason of their
background, education training, or experience, possess
expertise in scientific and technological pursuits, as well
as the use and implications of the use of such pursuits."
No more than three of the 15 may be Federal employees.
The 12 individuals listed above clearly satisfy the statutory
criteria. Five are from academia (Wilkening, Coleman,
Alvarez, Kerrebrock, and Field), six from industry and
business (Yeager, Armstrong, Fitch, Paine, Webb, and Herzfeld),
and one (Sullivan) is an astronaut (Yeager and Armstrong
are, of course, former astronauts). The only clear Federal
employee is Sullivan. Field may be considered such because
he works part-time for the Smithsonian. In any event, the
statutory limit of three Federal employees has not been
exceeded.
As might be expected in this field, all of the prospective
appointees have consultant positions or arrangements with
high-tech firms that some might consider to present a
conflict of interest. Indeed, even the current astronaut
might be considered to have a conflict in that she might

favor manned space flight over unmanned options. I do not,
however, consider these affiliations disabling. It was
obviously the intent of Congress that the Commission be
composed of a broad range of experts in the field (not
solely academics) ; such experts inevitably earn their living
through such consulting. In addition, the agenda the
Commission is to formulate seems broad enough to attenuate
any potential conflicts.
I have not yet received a PDS from Jeane Kirkpatrick.

COMMENTS:
MacDonald G. Becket is being considered for reappointment to
the National Institute of Building Sciences (NIBS) "as
representative of the public interest," 12 U.S.C. § 1701j-2 (c) (4).
Mr. Becket meets the statutory requirements for this appointment.
The statute provides that "[t]hose representing the public
interest on the board shall include architects " id.
§ 1701j-2 (c) (1), and Mr. Becket is an architect. The
statute also provides that "[s]uch members of the Board
shall hold no financial interest or membership in, nor be
employed by, or receive other compensation from, any company,
association, or other group associated with the manufacture,
distribution, installation, or maintenance of specialized
building products, equipment, systems, subsystems, or other
construction materials and techniques for which there are
available substitutes." Mr. Becket confirmed that he had no
affiliation that would disqualify him under this provision.
Mr. Becket's financial interests are primarily in his
architectural firm and partnership interests in projects
developed by his firm. He was originally cleared by Ed
Wilson for appointment to the NIBS board in early 1983.
Reappointments are authorized, see 12 U.S.C. $
1701j-2 (c) (3), but no individual may serve more than three
consecutive three-year terms. This is Mr. Becket's first
reappointment.
I should note that Mr. Becket serves as "honorary consul"
for Sri Lanka, a position that triggers the Foreign Agents
Registration Act (FARA) and would appear to subject him to
disqualification under 18 U.S.C. $ 219. That provision
makes it a felony for an employee of the United States to
act as an agent for a foreign principal required to register
under FARA. The NIBS enabling statute, however, specifies
that "[t]he members of the initial or succeeding Boards
shall not, by reason of such membership, be deemed to be
employees of the United States Government." 12 U.S.C.
§ 1701j-2 (c) (6). Accordingly, the prohibition of 18 U.S.C.
§ 219 is not triggered, and does not represent an obstacle
to Mr. Becket's service on the NIBS board.

to be Ambassador to Costa Rica
I have reviewed the SF-278 and related materials submitted
by Mr. Tambs in connection with the above-referenced nomination,
and have no objections. I would note, however, that Mr.
Tambs participated in the controversial "Ambassadors for
Senator Helms" episode in 1984. (Tambs was then and is now
Ambassador to Colombia.) Many objected to the politicization
of the diplomatic corps by those ambassadors who signed on
to support Helms; I would think Tambs can expect opposition
on this score.

SUBJECT:
Reappointments of Charles Hauser and
Truman Cline to the Architectural and
Transportation Barriers Compliance Board
Pursuant to 29 U.S.C. $ 792 (a) (1) (A) the President is
authorized to appoint eleven members to this Board from the
general public, of whom five shall be handicapped individuals.
Reappointments are authorized, but no member may be reappointed
more than once without a hiatus of at least two years in
Board service. It is the function of the Board to ensure
compliance with the Architectural Barriers Act of 1968 and
to explore and report on various issues relating to access
by the handicapped. See 29 U.S.C. § 792 (b).
Truman Cline is a retired industrial engineer and, as a
triple amputee, qualifies as a handicapped member of the
Board. Charles Hauser has overcome the handicap of his
family name, but that does not qualify him as a handicapped
member of the Board. He is President of Hauser Associates,
a design consulting firm. I have no objection to either
reappointment.
