SUBJECT:
Referral from Senator Stevens of Dayton
Child's Effort to Reduce the National Debt
Senator Stevens has inquired concerning the lack of a
response to a letter his constituent, Dayton Child, wrote
the President. There is no record of the Child letter ever
arriving at the White House. The copy provided by Senator
Stevens indicates that Child wants to reduce the national
debt by establishing "Uncle Sam Christmas Funds" at local
savings and loan associations. He apparently enclosed bank
signature cards for one such fund in his original letter for
the President to sign. A draft advertisement attached to
the letter urges that donations to cut the national debt be
sent to the fund, "c/o President Ronald Reagan," at a Homer,
Alaska savings and loan.
I have drafted a letter advising Child that gifts to reduce
the national debt can be made directly by private citizens
to the Secretary of the Treasury, and that there is no need
nor is it appropriate to use the device of an account in the
President's name. See 31 U.S.C. §§ 901-904. I have also
attached a brief note advising Senator Stevens of this
disposition.

Dear Mr. Child:
Senator Stevens has forwarded to the White House a copy of
your January 3, 1983 letter to the President. Your original
letter inexplicably did not arrive in this office until
March 2. Please accept our apologies for the delay in
responding. In your letter you described your idea to help
reduce the national debt by establishing accounts for this
purpose at local savings and loan associations. You also
enclosed and requested that the President sign signature
cards for one such account.
In 1961 Congress enacted a law providing that the Secretary
of the Treasury may accept, on behalf of the United States,
"any gift of money made on the sole condition that it be
used to reduce the public debt of the United States.' " 31
U.S.C. § 901 (a). Gifts to reduce the national debt, there-
fore, need not be and appropriately should not be made
through the use of an account in the President's name.
Private citizens such as yourself can make the desired gift
directly to the Secretary of the Treasury. You are free to
establish accounts for the purpose of collecting such gifts,
but the accounts should not be in the President's name.
Accordingly, I am returning the signature cards, unsigned,
to you for appropriate disposition.
When a gift to reduce the public debt is received by the
Secretary of the Treasury, the money is credited to a
special account. The money in this account is then period-
ically used to reduce the public debt of the United States.
31 U.S.C. § 904. For your information, I have enclosed
copies of the provisions governing gifts to reduce the
national debt, including those cited herein.
If you have any further questions, I am certain that the
appropriate officials at the Department of the Treasury, who
administer the special account referred to above, would be
happy to assist you.

to run in our local newspaper next week.
In support of your efforts at decreasing the national
debt, I have started an "Uncle Sam Christmas Fund" at a
local Savings and Loan Association. This idea was spawned
after watching the late night news one evening telling us
that the national debt will reach $200 billion. We're
constantly bombarded with requests for donations for all
sorts of worthwhile causes. What's more worthwhile or more
important than our own national economic well being? We

We asked for, and received, the Chamber of Commerce's endorsement.
The local paper generously donated the advertisement for the account,
and has run several articles about the idea. A local restaurant is
donating one day's receipts toward the fund. We're organizing a
rummage sale; having a benefit basketball game, and planning a com-
munity barbeque, and all proceeds go toward the fund.
The school kids are doing up a float for the Winter Carnival parade,
and conned one of the teachers into dressing up as Uncle Sam. They
are making posters for use, and I'll send you one when they are done.
The local interest in this is growing, and can be handled by us. But
when we start getting letters and phone calls from North Carolina,
and copies of the newspaper article from Seattle's newspaper, we
know we are getting out of our league.
Right now, there is an Uncle Sam account in thirty-six areas with
the National Bank of Alaska; three with the Kenai Peninsula Savings &
Loan Association; accounts with the Alaska State Bank, and a new one
with a bank in Kodiak. We sure would like to see it in every bank,
in every town, in Alaska.
But why stop there? Why not in every town in America? So far, there's
an account being opened in California and Nevada. This has enormous
national potential, SO let's deal with it on a national scale.
I've been told by the people giving the money, that it makes them
feel like they are directly helping our country with one of its
greatest difficulties. Remember the patriotism we had during the
second World War? It sure helped pull our country through. a tough
time. Let's do it again.
I'm asking for your help. I need somebody who knows P.R. to keep
this thing going. And I need someone with a national standing to
lend some credabiltiy to this idea.
I'm enclosing some news clippings and letters, and a button that
Mary and I designed (and paid for out of our own pockets). If you
help us out, you can wear it.

Correspondence from Rumiko Joseph
Rumiko Joseph has written asking if there are any legal
problems with the plan described in an attached copy of a
letter to the President from Rodney Randy Joseph. Under the
plan Rodney Randy Joseph would approach various Cabinet
officers for their help in organizing a charitable effort.
The Office of Private Sector Initiatives advises that Joseph
is an indefatigable and frequent correspondent whom they no
longer take seriously. They recommend no response, and I
agree.

Thank you for your letter of December 16, 1982, concerning
your proposal to reform the welfare system. In that letter
you indicated that you would like to add the President's
name to the proposed "Joseph, Kennedy Welfare Act. "
Quite apart from any consideration of the merits, it would
be inappropriate for the President to lend his name to any
bill or other legislative proposal, and the President --
like his predecessors -- has adhered to a policy of not
doing so. We cannot, therefore, approve the addition of the
President's name to your draft proposal.
I understand that you have been in contact with the Office
of Private Sector Initiatives at the White House concerning
your project. I am confident that they will give your
proposal every appropriate consideration. Thank you for
sharing your ideas with me.

Herbert Budek Discrimination Complaint
A Dr. Herbert Budek has written James Baker, whom he describes
as his "last hope" in connection with a five-year old racial
discrimination case. The facts of the case are not clear
from Budek's recital. What is clear from the letter is that
his file was turned over to the Justice Department, that he
filed information with the Labor Department and received a
ruling from them, that he contacted both Justice and Labor a
second time, that his complaint was referred to a regional
office in San Francisco, that when Budek was unsatisfied
with the response of that office he again contacted Labor in
Washington, and that Budek has received a reply from Labor's
Office of Civil Rights. We should advise Budek that the
White House cannot interfere in agency handling of private
complaints, and that if he wants to pursue the matter
further he should contact private counsel.

Correspondence from A.R. Ceresa,
Trustee of the Rossmoor Liquidating
Trust, to Michael Deaver
A.R. Ceresa, trustee of the Rossmoor Liquidating Trust, has
written Michael Deaver about litigation involving his
company and the Marine Corps. According to Ceresa's letter,
the Marine Corps has imposed land use restrictions on
property owned by Ceresa's company. Ceresa wants to develop
the land, but was unsuccessful in negotiating a modification
of the restrictions and brought suit last year. On March 7,
1983 a federal district court denied a Marine Corps motion
for summary judgment and set an October date for a full
hearing. Ceresa states that he wants to avoid lengthy
litigation and offer a substantial settlement, but the
Marines have rebuffed his overtures. He would like to
discuss the matter with Deaver.
It would be inappropriate for Deaver to meet with a personal
friend to discuss settlement of a pending lawsuit filed by
that individual against the United States. I have prepared
a reply for Deaver's signature, advising Ceresa of this
fact, and a transmittal memorandum to Deaver.

Dear Mike:
I seek your advice regarding a matter involving my company and the U.S.
Government. Cognizant of your time constraints, I have been brief in my
explanation.
For over two years we have attempted to negotiate a modification of land
restrictions
from the Marine Corps Air Station,
E1 Toro. A modification of restrictions will allow the development of an
office complex resulting in $176,000,000 in construction and the creation of
6,500 jobs. Negotiations broke down in 1981, and as a result, in February,
1982 we were forced to file a lawsuit in Federal Court. Yesterday, the court
denied the Marine Corps' Motion for Summary Judgment, thereby allowing the
matter to go to full hearing in October of this year. We feel confident the
court will rule that the restrictions are unenforceable, however, we would
prefer to avoid the lengthy process of litigation (appeals, etc.) and resolve
our differences with a substantial monetary and/or equivalent value settlement.
Our settlement overtures to date have been rebuffed by both the Marine Corps
and the Navy Department.
Since I am not experienced in the workings of government, I am at a loss as
to how or whom to approach at the higher levels of government to initiate
settlement discussions.
Mike, some time ago you mentioned that if I were ever in Washington, D.C. to
call you and we would get together. Respecting your position and busy schedule,
I would like to take you up on your invitation and explain this matter in more
detail. Since we have a project in Montgomery County, Maryland, I am frequently
in your area. Thanks for your precious time.
