THE WHITE HOUSE WASHINGTON April 18, 1984 Dear Students: Thank you for your letter to the President concerning the right to privacy, and the threat to that right represented by the ever increasing number of personal files maintained by government at all levels. In your letter you stated that you considered it an invasion of privacy that such records could be released without your knowledge or consent. We certainly share your concern to protect the right to privacy, and recognize the danger posed if personal records are not maintained with sufficient safeguards to prevent misuse of the information they contain. I would point out that Congress passed the Privacy Act in 1974 to guard against just such potential invasions of privacy. A copy of that Act, as codified, is enclosed for your information. You will notice that the Privacy Act generally provides that "[n]o agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains " 5 U.S.C. $ 552a (b). There are a series of exceptions for circum- stances in which Congress determined the privacy interest to be outweighed by other compelling factors. The Privacy Act also provides for access by individuals to their records, and imposes limits on agencies concerning the maintenance of records on individuals. I certainly share your concern that individual files maitained by the government should remain confidential. As you may know, the Congress passed the Privacy Act in 1974 to guard against just such potential invasions of privacy. In general, one section of the law prohibits an agency of the federal government from disclosing any records of an individual "except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains 11 5 U.S.C. 552a(b). Section 552a(b) also sets out several narrowly drawn exceptions to this prohibition. Michael Uhlmann, Assistant Director for Legal Policy, Office of Policy Development, has workd in this area, and would be better able to respond to the broader policy questions you raise. Immediately prior to her conviction of attempted murder, she had uncovered serious evidence of black-marketing and corruption in the Army. Other elected officials have been notified and supplied packets of data similar to that which was sent to you. The City of Fresno has taken the Babbitt case very seriously, Mr. President: many people have written the elected officials; petitions are being circulated throughout the County in her behalf; and the local media have covered it extensively. Moreover, as a City Councilman, on February 14, I introduced a resolution for Council action calling for a thorough investigation; it passed unanimously and is remitted herein. The Babbitt case is not only a denial of due process but a direct assault on Human Rights, an issue that has been highlighted in international politics in recent years. It is also in contravention of the Governments' avowed intent to root out fraud and corrupt practices, and to protect federal employees brave enough to "blow the whistle." Of no small consideration is the deliberate destruction of Captain Babbitt's military career. As our Commander-in-Chief, President Reagan, we must now look to your leadership to undo the manifold wrongs that have been wrought against Brenda Babbitt by the U. S Army. Army, is now in prison for having shot an intruder in her living quarters in Grafenwoehr, Germany, in November, 1982; and WHEREAS, many facts relevant to the case were not taken into account at her trial; and WHEREAS, there is strong evidence that Captain Babbitt was found guilty in order to curtail her study of illegal activities within the Army and silence revelation of same; and WHEREAS, Captain Babbitt was the victim of sexual debasement and prejudicial treatment both prior to and subsequent to subject incident; and WHEREAS, there is evidence of substantial theft of her personal property by Army personnel; and WHEREAS, the makeup of her jury displayed a deliberate structure certain to convict her due to conflicting interests; and WHEREAS, the lengthy incarceration has caused severe hardship to her two small children and her cancer-stricken parents, who have had to relocate to Leavenworth, Kansas, to care for the children. But my Dog Spot is so pissed off at the FCC that there is just no way that I have been able to talk to him on a rational basis as a man should be able to talk to his dog. So, to keep peace in the family, I hasten to write to you, especially since it has been announced that Sr. Miguel de la Madrid, the President of Mexico, is coming to visit you at the White House on May 15th. Well, do we have some good news for him! I think you and President de la Madrid ought to know that the Federal Communications Commission has just accused the Republic of Mexico of violating United States law. Specifically, the Commission staff has alleged in the attached document that the Republic of Mexico controls the operations of seven United States television stations of which I am a shareholder and President, in violation of Section 310(b) of the Communications Act of 1934. I hope this letter has not dropped from your hands onto the floor as they administered your smelling salts. What I was saying when your eyes glazed over, Mr. President, is that the Republic of Mexico and Sr. de la Madrid are in deep guano at the FCC. Given the imminence of his visit, it might be a good idea if you were to call Sr. de la Madrid and advise him that the FCC has got the goods on him and his Republic and that, more important than bringing along a tuxedo for the black tie affairs in Washington, he had better bring along some good lawyers. It is not true that the entire legal profession in the United States is occupied in either attacking or defending the companies I operate. There must be a few firms out there who could offer their services to defend President de la Madrid and his government in the FCC hearing they got themselves involved in. Perhaps someone on your staff could recommend a good firm. The problems arose because these seven Spanish language television stations are presently in a hearing at the FCC to determine whether or not they are really controlled by foreign aliens. Up till now, it has been alleged by my admirers that the stations were controlled by the Mexican television network, Televisa, or by the Azcarragas who control Televisa, and also control Rene Anselmo and his Dog Spot. Since Rene Anselmo controls the stations and the foreign aliens control Rene Anselmo, the stations are thus under foreign control. Or so the theory goes. I guess some foreign relations intern at the FCC figured these charges didn't sound horrible enough and decided to finger the Mexican government as the main culprit or controller of Rene Anselmo. Per- President Ronald Reagan Washington, D.C. 4/19/84 Page -3- sonally, I think this is unconscionable. If the FCC knew all along that it was the Mexican government who was controlling these stations, why didn't they let me know? Especially since I am accused in the same document of being an agent of the government of Mexico. Here I am running around thinking I'm supposed to be controlled by Televisa and the Azcarragas and all along I was really being controlled by the Mexican government. What kind of alleged agent does that make me look like? My Dog Spot says I am going to look like an asshole in the international undercover community. He says that if I worked for the CIA they would have demoted me to the Nicaraguan Desk over something like this. So the tempers are flaring up all over. Melissandra says that if the Mexican government has been controlling our stations they ought to damn well go out and get their own lawyers. As for me, I'm too busy defending myself to take up the defense of the Republic of Mexico as well. Maybe Ambassador Gavin can give them some advice. They are sure going to need it, 'cause I'm telling you, Mr. President, it's a real ZOO down there at the FCC. While we are on the subject, I wonder if I could ask a favor of you. I have another school of admirers who claim that I am an agent of the Communist Party. I would appreciate it if someone on your staff could check with their KGB connections and let me know if this is true. I'll be at home over the weekend hoping to get my onions planted. We have had so much rain in Connecticut it has been impossible to work the soil till now. Do you and Mrs. Reagan have a vegetable garden at the White House? If so, I hope you've got your onions in. ROBERTS SUBJECT: Alan Hepworth Complaint Regarding Lack of Response to His Letters to Administration Officials in Which He Requests Investigation into Violation of his Civil Rights Alan Hepworth of Miami Beach has written Mr. Baker to complain about the lack of response to his many letters concerning an alleged violation of his rights. It is unclear from Mr. Hepworth's numerous letters precisely what he is complaining about, but it is clear that he regards William P. Tyson, Director of the Executive Office of U.S. Attorneys, as the villain of the piece. Tyson made what in retrospect can only be regarded as the mistake of innocently responding to Mr. Hepworth in August of 1983. This latest letter should be referred to Justice for whatever action they deem appropriate; we certainly do not want to respond directly from the White House. An appropriate memorandum is attached. In your letter you stated that\nyou considered it an invasion of privacy that such records\ncould be released without your knowledge or consent.\nWe certainly share your concern to protect the right to\nprivacy, and recognize the danger posed if personal records\nare not maintained with sufficient safeguards to prevent\nmisuse of the information they contain. I would point out\nthat Congress passed the Privacy Act in 1974 to guard\nagainst just such potential invasions of privacy. A copy of\nthat Act, as codified, is enclosed for your information.\nYou will notice that the Privacy Act generally provides that\n\"[n]o agency shall disclose any record which is contained in\na system of records by any means of communication to any\nperson, or to another agency, except pursuant to a written\nrequest by, or with the prior written consent of, the\nindividual to whom the record pertains\n\" 5 U.S.C.\n$ 552a (b). There are a series of exceptions for circum-\nstances in which Congress determined the privacy interest to\nbe outweighed by other compelling factors. There must be a\nfew firms out there who could offer their services to\ndefend President de la Madrid and his government in\nthe FCC hearing they got themselves involved in.\nPerhaps someone on your staff could recommend a good\nfirm.\nThe problems arose because these seven Spanish\nlanguage television stations are presently in a\nhearing at the FCC to determine whether or not they\nare really controlled by foreign aliens. Up till\nnow, it has been alleged by my admirers that the\nstations were controlled by the Mexican television\nnetwork, Televisa, or by the Azcarragas who control\nTelevisa, and also control Rene Anselmo and his Dog\nSpot. Since Rene Anselmo controls the stations and\nthe foreign aliens control Rene Anselmo, the stations\nare thus under foreign control. Or so the theory\ngoes.\nI guess some foreign relations intern at the FCC\nfigured these charges didn't sound horrible enough\nand decided to finger the Mexican government as the\nmain culprit\nor controller of Rene Anselmo. Per-\nPresident Ronald Reagan\nWashington, D.C.\n4/19/84\nPage -3-\nsonally, I think this is unconscionable. If the FCC\nknew all along that it was the Mexican government who\nwas controlling these stations, why didn't they let\nme know? Especially since I am accused in the same\ndocument of being an agent of the government of\nMexico.\nHere I am running around thinking I'm supposed to be\ncontrolled by Televisa and the Azcarragas and all\nalong I was really being controlled by the Mexican\ngovernment. What kind of alleged agent does that make\nme look like? My Dog Spot says I am going to look\nlike an asshole in the international undercover\ncommunity. He says that if I worked for the CIA they\nwould have demoted me to the Nicaraguan Desk over\nsomething like this. So the tempers are flaring up\nall over.\nMelissandra says that if the Mexican government has\nbeen controlling our stations they ought to damn well\ngo out and get their own lawyers. As for me, I'm too\nbusy defending myself to take up the defense of the\nRepublic of Mexico as well. Maybe Ambassador Gavin\ncan give them some advice.
