Dear Mr. President:
I am required by the Pelly Amendment to the Fishermen's Protective Act
of 1967 to certify to you my determination that nationals of a foreign
country, directly or indirectly, are conducting fishing operations which
diminish the effectiveness of an international fishery conservation
program. By this letter, I am certifying that nationals of the Soviet
Union are conducting whaling operations that diminish the effectiveness
of the International Whaling Commission's (IWC) conservation program.
My decision is based on the fact that the IWC quota for Southern Hemisphere
minke whales has been exceeded as a result of the harvest by the Soviet
Union. I am certifying the Soviet Union for the taking of minke whales
under both the Pelly Amendment and the Packwood-Magnuson Amendment to
the Magnuson Fishery Conservation and Management Act of 1976.
Upon certification under the Packwood-Magnuson Amendment, the Secretary
of State must, in consultation with the Secretary of Commerce, reduce
fish allocations to the certified country by not less than 50 percent.
This reduction applies to any unharvested allocations and to all allocations
to be made within 365 days from the date of certification, until
decertification is warranted.
The Pelly Amendment provides that upon receipt of this certification,
you may direct the Secretary of Treasury to prohibit the importation of
some or all fish products from the country involved into the United
States. The Pelly Amendment also provides that within 60 days following
the receipt of this certification, you must notify the Congress of any
action you take regarding the certification, and you must inform the
Congress of the reasons for any such action that falls short of prohibiting
the importation of all fish products of the certified countries.
I have notified the Secretaries of State and Treasury, and the Chairmen
of the Council on Environmental Quality and the Marine Mammal Commission,
of this certification. The Department of Commerce is developing trade
recommendations on fish import prohibitions and will make recommendations
to you about further actions before the end of the 60-day period when the
report to the Congress is due. I have recommended to the Secretary of
State that the Government of the Soviet Union be advised of this
certification. In addition, I will suggest to the Soviet Minister of
Foreign Trade that we could discuss the certification of Soviet whaling
at the meeting of the joint U.S.-U.S.S.R. Commercial Commission May 20-21
in Moscow, if he believes it would be useful.

On Wednesday, April 3, a meeting is scheduled at the White House that will
include representatives of various groups that are involved in the child safety
issue. The purpose of the meeting is to coordinate efforts of the various
groups and develop a partnership in which the Justice Department will take
the lead. Although a formal council will not be developed, it is anticipated
that this partnership will be called the "National Partnership for Child
Safety".
I wanted to clear this meeting with you to be sure there are no legal
objections.

Cerebral Palsy Bid Auction for a White House tour. I
realize that the White House does not contribute auction
items, but wondered if it is possible for lunch with a
White House Staff Member in the Mess to be auctioned
?
(either alone or in conjunction with two Congressional tour
tickets) Apparently transportation and lodging is being
offered in conjunction with the tour bid (see attached
letter).

Please find enclosed a copy of a letter from Mrs. David T. Roberts,
Co-Chairman of the Cerebral Palsy Bid Auction which is to be held in
connection with the Cerebral Palsy 25th Anniversary Benefit Ball of Dallas,
Texas on April 27. I understand that unfortunately your office never received
the original correspondence. I wish to help the Cerebral Palsy Association
with their request and therefore have enclosed, for your review, a copy of
their original letter and one delivered to my Dallas office.
As you can see, the auction officials wish to offer a White House tour in
connection with a bid item that includes transportation and lodging offered
by Braniff Airlines and the Four Seasons Hotel respectively. Although I
understand that White House policy does not allow tours or items from the
White House to be auctioned, I am nonetheless hopeful that through your
efforts it may be possible to arrange a substitute tour or make other adequate
arrangements.
Should your office be able to help, it is important that Mrs. Roberts hear
from you soon, inasmuch as the publicity campaign for the auction will begin
soon.
Mrs. Roberts and the other volunteers for the charity are very enthusiastic
about the potential of the auction. They feel that a White House tour will
bring great interest to the bidding for this worthy cause. Your efforts are

1985 Cerebral Palsy Ball. The tour would take place at whatever date

Reagan, however, briefly, would be so highly prized it would bring a

however we realize due to both of your busy schedules this would not
be possible. Perhaps you might be gracious enough to send us a
favorite item of the President or an autographed memento.
The 1985 fundraiser, "Treasures of the Nile" will be held April 27,

sell-out is expected with over 1,700 guests in attendance to view and
bid on live and silent auction items. The Ball held by Cerebral Palsy
Guild is one of the largest and most successful charity events in

Dear Mr. Leibman:
Thank you for your letter to Counsel to the President Fred
F. Fielding concerning a television advertisement developed
by Art Pierson & Co. for Ace Hardware Corporation. Accompany-
ing that letter was a script of the advertisement, which
features Rich Little imitating Presidents Nixon, Carter, and
Reagan. You inquired if we had any objection to the commercial.
The White House adheres to a policy of declining to approve
any use of the President's name, likeness, photograph,
signature, or voice in any manner that suggests or could be
construed as endorsement of a commercial product or enterprise.
In a certain sense, the proposed advertisement will feature
the President's voice, but the appearance of Mr. Little
during the advertisement should suffice to remove any
suggestion that the President himself is endorsing the
advertised products. Accordingly, this office has no
objection to the planned imitation of the President's voice
in the advertisement.

I must decline to grant the permission you requested. The
White House adheres to a policy of declining to approve any
use of the President's name, likeness, photograph, signature,
or voice in any manner that suggests or could be construed
as endorsement of a commercial product or enterprise. Use
of a recording of portions of the President's speech in your
advertising for In God I Trust would convey the impression
that the President has endorsed the book, contrary to this

We are the radio agency for Tyndale House Publishers, which
published Mr. Reagan's book, In God I Trust, compiled by
David Sheppard. Enclosed is a cassette and some hard copy
for the 30 and 60 second commercials we produced for the
book. Before we do anything, with it, we need a letter of
authorization to use Mr. Reagan's voice on the spot.
The portions were taken from the President's speech before
the 1984 National Religious Broadcasters' Convention. He
is not endorsing his book, only affirming his faith.
Can you give us authorization to distribute this spot to

This letter is in regard to the murder of the Chinese American
journalist Henry Liu. I urge you to secure the extradition and
prosecution of those suspected in the October 15, 1984 murder.
On November 29, 1984 the F.B.I. and the Daly City Police Department
identified and named four suspects in the murder of Mr. Liu: Chen Chi-
li, Wu Tun, and Tung Kuei-sen, all of Taiwan, and David Yu, of San
Gabriel, CA.
Local and federal law enforcement investigators have uncovered
substantial evidence to conclude that (1) the murders of Henry Liu
conspired successfully to deprive him of his First Amendment rights,
and (2) foreign agents were the instigators and executioners of the
murder of this Chinese American citizen.
On February 1, 1985 the Taiwan government announced that it will not
be extraditing the suspects to the United States. The Taiwan Justice
Minister stated that the suspects would be tried under Taiwan laws. In
response, our government has voiced no concern and made no strong plea
for the return of these suspects to stand trial for a murder of a U.S.
citizen on U.S. soil by foreign agents.
Again, I urge you to take the necessary steps to ensure the return of
these individuals suspected of carrying out the execution of Henry
Liu. By your orders let the Departments of State and Justice secure
this extradition and see that justice is fairly and finally served.

In August, 1984, President Reagan was gracious enough to videotape a message
for presentation to the Paralyzed Veterans of America's annual convention.
At that time, we noted that the contents of the tape would receive wider
dissemination. Toward that goal we supplied videotape copies of the President's
comments to television stations in New Orleans (the site of our convention) and
audio copies were provided to many news organizations.
As you will note from the attached, the Paralyzed Veterans of America has
been most active in the area of television public service announcements --
with special emphasis given to distributing spots for use in the Memorial
Day and Veterans Day period.
For Memorial Day 1985, we would like White House permission to use portions of
the President's remarks to our group as the basis for a 60-second public
service announcement. This public service announcement is not designed, in
any manner, as a fund raising device.
In terms of the supporting visual scenes, at the beginning of the spot, the
President's voice is heard while viewers see footage from Vietnam depicting
United States soldiers exiting helicopters. The footage, does not show
combat in any way and is "generic" in nature.
Attached is a copy of the President's remarks to PVA. I have marked those
sections which we have excerpted for the 60-second spot.

It's an honor and a pleasure to have this opportunity to speak to 11 of you
attending the annual convention of the Paralyzed Veterans of America. I'm
sorry I couldn't be with you in person but, believe me, I'm there with you in
heart and spirit.
And, I'm pleased that one of my assistants here at the White House, Jack
Svahn, is able to meet with you in New Orleans.
The greatest privilege of my office has been to lead those who wear
America's uniform. And nothing means more to me as President than to
live-up to the trust of our servicemen and women, past and present.
On Memorial Day our nation laid to rest an unknown of the Vietnam
conflict--it was a day of healing and remembering, of caring and feeling.
America joined hands and opened her heart in gratitude. Then several days
later, on the wind-swept beaches of Normandy, Heads of State, veterans and
citizens paid tribute to the heroes of D-Day. Speeches could never
adequately portray their suffering, their sacrifice, their heroism
but we
understood. You went to Omaha Beach, and Guada Canal, M.I.G. Alley
and Pork Chop Hill, Khe San and the Iron Triangle and a thousand other
places. And you went to give--not for yourself, but for others. Not to
conquer, but to liberate. You kept faith with America and our way of life.
And don't ever forget we wouldn't be free long but for your dedication. Our
heritage of liberty and justice couldn't be preserved but for your
sacrifices.
Your sacrifices and hardships are with you everyday of the year. But I know
that you want neither paternalism or pity. All you want is the opportunity
to contribute to your communities and your country, to use your creativity
to go as far as your God-given talents will take you, and to have your
special needs met.
And your government will not let you down. We will not forget our nation
has a special commitment to those who served and sacrificed. And, that
commitment includes both continuing respect and practical, meaningful
assistance in first rate health-care and medical research, in vocational
rehabilitation and efforts that offer self-reliance, human dignity and
independence.

Reprinting of the President's Abortion
Article
Kathleen Bursley, an attorney for Harcourt Brace Jovanovich,
Inc., has written to ask for a public domain copy of
"Abortion and the Conscience of the Nation," by the
President. Harcourt wants to include the article in a
college rhetoric text as an example of argumentation. They
approached Thomas Nelson, Inc., which published the article
in book form, for permission. Thomas Nelson is demanding a
fee of $1,000, which Bursley considers exorbitant under the
circumstances.
You will recall that this article first appeared in the
Summer 1983 issue of Human Life Review, and was copyrighted
at that time by the publisher of Human Life Review, The
Human Life Foundation, Inc. The article was later published
in book form by Thomas Nelson, pursuant to an arrangement
whereby royalties benefit The Human Life Foundation. You
approved the Nelson reprint and the royalties arrangement by
letters dated November 7, 1983. The article has also been
distributed by the White House in pamphlet form, bearing the
Seal of the President, with no copyright notation.
As I read the law, no copyright protection is available for
the article. There was no basis for the publishers of Human
Life Review to copyright it when it first appeared. The
article was clearly Government work, and not the private
product of the President. It was drafted by OPD and Speech-
writers, with editing by Peter Rusthoven of this office, and
went through the White House clearance process. There is no
copyright protection "for any work of the United States
Government." 17 U.S.C. § 105. "Work of the United States
Government" is defined to be "a work prepared by an officer
or employee of the United States Government as part of that
person's official duties.' 17 U.S.C. § 101. The article
clearly fits that definition from the perspective of those
on the White House staff who prepared it. Since it
expresses the President's view on a public policy issue, and
was designed to shape the debate on that issue, the article
should also be considered to have been prepared by the
President in the course of his official duties.
The Presidential Records Act confirms this conclusion. The
article certainly qualifies as a Presidential record, see 44
U.S.C. § 2201, and ownership, possession, and control of
such records is retained by the United States, 44 U.S.C. $
2202.
My recommendation would be to send Harcourt one of the White
House pamphlets of the article, advising that no permission
is necessary to reprint it. I would alert The Human Life
Foundation and Thomas Nelson before doing so, since they are
apparently under the impression that they have some rights
to the article. I have not called them yet, however, since
the fact that the article was copyrighted by the Foundation,
and the fact that this office has granted reprint permission
(to Thomas Nelson) and denied reprint permission (to
Charisma) suggest my view of the law may not have been
previously operative in this area. Peter may have discussed
these issues with you; perhaps there are some facts (not
revealed in the file, which I have reviewed) of which I am
unaware. Please advise.
