Both of these matters may be closed out. I discussed both
on March 11 with Jerry Jennings of the Office of Science and
Technology Policy. I advised Mr. Jennings that the require-
ment in the OSTP appropriations bill that OSTP reimburse
other agencies for at least one-half of the personnel
compensation costs of detailees was not unconstitutional. I
also advised him that we could not support revising the
Executive Order establishing the National Commission on
Space to vest certain responsibilities under the Federal
Advisory Committee Act with respect to that Commission in
the Director of OSTP rather than NASA. I have discussed
both items with Mr. Hauser.

White House Liaison with the
National Commission on Space
Counsel's office has reviewed the proposed memorandum for Thomas
Paine, Chairman of the National Commission on Space, from an as yet
unidentified author, specifying that (1) the Director of the Office
of Science and Technology Policy (OSTP) shall serve as White House
liaison with the Commission, (2) the Commission shall report to the
President through the Senior Interagency Group for Space, and
(3) the Director of OSTP shall serve as liaison between the Senior
Interagency Group and the Commission.
Although there is, strictly speaking, nothing legally objectionable
in sending the proposed memorandum, we do not see any need for such
a formal step, which may create unnecessary controversy. The
statute establishing the Commission specifies that it is to submit
its report to the President, Public Law 98-361, $ 204 (c), and
Commission members might object to reporting through another
administrative entity. The President can easily refer the report
to the Senior Interagency Committee once he receives it from the
Commission. As far as the liaison responsibilities of the Director
of the OSTP are concerned, those can be more informally
communicated in a letter from the Director, indicating that he has
been designated to assist the Commission with any questions it may
have concerning the White House.

National Commission on Space
Public Law 98-361 established the National Commission
on Space, and required the Commission to report a long range
plan for civilian space activities to the President and to
certain Congressional committees. The Director of the Office
of Science and Technology Policy shall serve as the White
House liaison with the Commission. The Commission shall
report to the President through the Senior Interagency Group
for Space, SIG (Space). The Director of the Office of Science
and Technology Policy shall also serve as liaison between the
SIG (Space) and the Commission.

Appointment of General Bernard A. Schriever
to the National Commission on Space
I have reviewed the Personal Data Statement submitted by
Bernard A. Schriever in connection with his prospective
appointment to the National Commission on Space. The
Commission was established by Public Law 98-361, 42 U.S.C.
§ 2451 note, to study space activities and formulate an
agenda for the U.S. civilian space program. The Commission
is to submit to the President and Congress a long-range plan
for civilian space activity.
Pursuant to Section 203 (a) (1) of Public Law 98-361, the
President is authorized to appoint 15 members to the Commis-
sion "selected from among individuals from Federal, State,
and local governments, industry, business, labor, academia,
and the general population who, by reason of their back-
ground, education, training, or experience, possess exper-
tise in scientific and technological pursuits, as well as
the use and implications of the use of such pursuits." No
more than three of the 15 may be Federal employees.
General Schriever is a self-employed consultant in the
aerospace field. He is a retired four-star general who was
responsible for the development of our ballistic missile
program. As is true with almost all members of the Commis-
sion, Schriever has financial holdings and interests in the
aerospace field. These should not preclude his appointment.
The statute looks to the appointment of individuals active
in space research and the exploitation of space, and the
agenda of the Commission is broad enough to attenuate any
potential conflicts. In addition, the Commission is purely
advisory, and does not engage in any regulatory activities.
I interviewed General Schriever on two separate occasions,
and can attest that he is very sensitive to the need to
avoid any conflicts problems. He has experience serving on
numerous advisory bodies and understands how the conflicts
laws apply. He should be cleared in time for the June 29
meeting of the Commission.

SUMMARY. This memorandum forwards for your consideration a
proposed Executive order that would extend by six months the time
within which the National Commission on Space may report its
recommendations.
BACKGROUND. The National Commission on Space was established
by Executive Order No. 12490 of October 12, 1984, to propose a
long-term agenda for the United States civilian space program.
Creation of the Commission was authorized by the National
Aeronautics and Space Administration Authorization Act, 1985
(Public Law 98-361), which required the Commission to submit its
plan and recommendations within twelve months of the date of the
Executive Order.
The Commission was unable to complete its report within the
time alloted. Therefore, by section 109 of the National
Aeronautics and Space Administration Authorization Act, 1986
(Public Law 99-170), Congress extended the time within which the
Commission may report until 18 months from the date of the
Executive Order. The proposed Executive order would implement
this statutory amendment by formally extending for six months the
time within which the Commission may report.
None of the affected agencies has objected to the proposed
Executive order.
RECOMMENDATION. I recommend that you sign the proposed
Executive order.

MEMORANDUM
Re: Proposed Executive order entitled

The attached proposed Executive order has been submitted by
the Office of Management and Budget, with the approval of the
Director, and has been forwarded to this Department for review of
its form and legality.
The proposed order will amend the Executive Order
establishing the National Commission on Space (Commission), Exec.
Order No. 12490, 49 Fed. Reg. 40393 (1984), in order to give the
Commission six more months in which to file its final report.
This extension of time was recently authorized by Congress. See
Pub. L. No. 99-170, S 109, 99 Stat. 1012, 1016 (1985).
The proposed Executive order is acceptable with respect to
form and legality.

By the authority vested in me as President by the
Constitution and statutes of the United States of America,
including Section 109 of the National Aeronautics and Space
Administration Authorization Act 1986 (Public Law 99-170), and
in order to extend the time within which the National Commission
on Space may submit its plan and recommendations, it is hereby
ordered that Section 2(b) of Executive Order No. 12490 is amended
by deleting the words "12 months" and inserting in lieu thereof
the words "18 months".
