Brock on the above-referenced topic. In the memorandum, Ambassador Brock notes that an investigation by the Inter- national Trade Commission (ITC) would supplement reviews currently being conducted by the Departments of Commerce, Justice, and Transportation, and that State, Commerce, and Transportation concur in the recommendation to request such an ITC investigation. The Department of Justice, however, has not had an opportunity to review the proposal in the memorandum. Particularly since Justice is currently active in this specific area, it should be provided such an oppor- tunity before the memorandum goes forward to the President. Brock 8 SUBJECT: Request for 332(g) Investigation Relating to U.S.-Japan Cargo Transport Services The United States has received a proposal by Japan to designate a new all-cargo air carrier to enter the U.S.-Japan cargo transport market. The Japanese request raises important trade policy questions at a time when we are experiencing trade in transportation services problems with the Japanese. Because of a need for an informed judgment as to the impact of an additional foreign cargo carrier on U.S.-Japan trade relations, I recommend, with the concurrence of the Department of State, Commerce and Trans- portation, that it would be useful to have analytical work done by the United States International Trade Commission on the current and prospective conditions of competition in cargo transport services between the United States and Japan. This analysis would be in addition to work presently underway by Commerce, Justice and DOT, who are examining different aspects of the question in the context of our bilateral aviation understanding with Japan. To this end it is my intention to have the United States International Trade Commission conduct an investigation pursuant to section 332(g) of the Tariff Act of 1930 on the economic effect of authorizing an additional Japanese all-cargo air carrier on U.S. companies providing like or directly competitive services as well as its effect on our transportation infrastructure.
