Dear Mr. Roeder,
I am enclosing herewith memorandum of our conference
on the 4th inst.
Mr. McGlynn tells me that his investigator
has learned some very interesting facts concerning the defen-
dant. We will have his report in the course of a few days.
The motion to advance the case on the calendar was
made before Judge Mountain on Saturday. Mr. McGlynn advises
me that Judge Mountain is inclined to advance the case but
that he assured Mr. McGlynn that he would give us ample time
for preparation. The matter was adjourned until next Satur-
day and Mr. Kalisch was directed to serve Mr. McGlynn with an
affidavit concerning the condition of the plaintiff.
Mr. McGlynn is giving notice of an application on
next Saturday for an examination of the plaintiff before trial
and for a physical examination by three physicians and one
dentist. The last mentioned applications will be argued be-
fore the Chief Justice. The application for examination before
trial is made necessary by reason of the fact that r.Kalisch
