Gentlemen: Attention: Mr. Lee.
This will acknowledge receipt of your letter
of the 8th inst., together with the enclosures referred to
therein.
It is our understanding that the complaint in
this matter was served upon the Company of July 3rd, but that
Mr. Roeder, who is named as a party defendant, has not yet
been served. We have talked with Mr. McGlynn this morning
about this new case, and it is perfectly agreeable to him to
make an arrangement with Mr. Kalisch similar to that in the
Carlough case, to the effect that no proceedings be taken for
the removal of the case to the Federal Court if the case is
discontinued as against Mr. Roeder. He does not, however,
wish to take any steps in the matter until the papers come to
him with instructions from the insurance company, but author-
ized us to take up the matter with Mr. Kalisch. We have not
yet been able to get in touch with Mr. Kalisch but will do so
as soon as we can reach him.
