Gentlemen:
We acknowledge the receipt of summonses
and complaints in the above captioned matters.
As no accidents to these claimants have
been reported and as it is impossible to determine
at this time whether any or all of the actions are
based on injuries accidentally sustained or result-
ing from vocational diseases, it is quite necessary
that the rights of the employer and insurance carrier
remain uneffected until the close of the litigations,
at which time, the coverage of the policies issued
you in 1917 and 1918 may be determined.
In no event, shall we be liable for damages
awarded James A. Larice, Louis Hussman and James
McDonald, who were not your employees.
Allegation 6 of the complaint of Edna
Hussman is to the effect that the plaintiff was
exposed to said radio-active substances from the first
day of June 1917 to the first day of February 1921.
Our policy expired Nov. 4th, 1919, and it will probably
be advisable for you to give notice of the suit to the
Company whose policy replaced ours.
We were not able to locate forms similar to
the policy issued you, but we enclose herewith photostat
copies of the applications on the reverse sides of which
is printed the terms and agreements of the policies.
