Dear Mr. Markley,
Mr. Berry called to see me today on the protext of
discussing the arrangements to be made for taking depositions
in Boston. I think that his real purpose in eoming to see
me was to sound me out as to whether the Radium Corporation
contemplates settling the cases.
I suggested that he name
a figure which he would accept, telling him, however, that,
in my judgment, the Radium Corporation could not consider
paying more than the nuisance value of the cases and that I
thought it doubtful if it would be willing to pay even that
because if a settlement of these cases were made other cases
would undoubtedly be brought and they would undoubtedly be
in a position where they would have to defend some cases or
else settle a great many.
I am sending a copy of this letter both to Mr. Lee
and Mr. Smith.
So far as I know there is no thought of settling
any of these cases but if your company believes that an ef-
fort should be made along this line I am willing to discuss
it with you.
