them for said alleged radium poisoning or the effects thereof, or been in
any way identified with the above causes in behalf of any party thereto;
that the defendant, within said time, shall appoint a physician having the
qualifications above mentioned and that the two physicians so appointed shall
forthwith agree upon and appoint a third physician having like qualifications
and in the event that such physicians shall be unable to agree said third phy-
sicians shall be appointed by the Honorable William Clark.
(5) In the event that the physician appointed by the plaintiffs
shall become incapacitated or resign, plaintiffs shall jointly appoint his
successor and in the event that the physician appointed by the defendant
shall become incapacitated or resign, the defendant shall appoint his succes-
sor. In the event that the physician appointed by such two physicians or
by the Honorable William Chark, as the case may be, shall become incapacitat-
ed or resign, such two physicians shall appoint his successor, or in the
event of their failure to agree a successor shall be appointed by the
Honorable William Clark.
(6)
Such agreement shall further provide that if said Committee of
physicians or the majority of them, shall, at any time, determine and report
that the female plaintiff party thereto is not, at the time of said report,
under any disability due to radium poisoning or to the effects thereof, then
no further payments of the annuity provided for by said agreement shall
be made to such plaintiff.
(7) Such agreement shall further provide that the defendant may, at
its option, provide and pay for such extraordinary medical treatments for
the purpose of curing such female plaintiff as may be determined by said
committee of physicians and that the said plaintiff who shall also execute
said agreement shall agree to take any treatments so provided.
(8)
Such agreement shall further provide that the defendant shall
pay the reasonable compensation and expenses of such committee of physicians
which, in the case of a disagreement between the members of such committee
and the defendant, shall be fixed by the said Honorable William Clark.
