Dear Dr. Fishbein:
I am herewith mailing you a duplicate set of the questions
which we are circulating among Dr. Stevens, Dr. Pohle and yourself, covering
the many points which we hope to question you on in Chicago on February 24th.
Some of these questions you may not feel qualified to
answer, and in order that we may have an idea as to the part of the question-
naire which you are qualified on we would appreciate your giving us a reaction
to these questions on the duplicate copy and mailing in the enclosed stamped
addressed envelope, so that it will reach me by Saturday February 22nd.
You will note in the questionnaire that we have made
reference to a number of articles occuring in the literature, and in order
that you may be saved some time in looking all of these various articles
up, I am sending you today by Parcel Post, special handling, a compendium
of articles which we have made up pretaining to the litigation in which we
are involved. This compendium may serve to refresh your memory on some
of these articles, for all articles referred to in the questionnaire will be
found in this compilation. We kindly ask that you bring this compilation
with you to the conference to be held on Monday, so that it may be returned
to our counsel, as the copy I am sending to you belongs to them.
It might also be well to bring with you the copy of the
questionnaire retained by you with your indicated answer, so that this would
be available in the event that the one returned to me by mail should be
delayed.
Messrs Smith and Markley, our attorneys, and I will arrive
in Chicago, Monday morning February 24th, and will be registered at the
Palmer House around 9:30 o'clock. We would like to have a preliminary
conference with you and your collaborators at the Hotel at 10 o'clock.
The depositions will be taken at one (1) o'clock in the afternoon at the
offices of Messrs Fallambee, Shorey & Schupp, 137 S. LaSalle St., before
Morris Cohen a Notary sitting as a Commissioner especially appointed for
this purpose.
Anticipating seeing you on Monday morning, I remain
