Dr. Herman Schlundt,
University of Missouri,
Columbia, Mo.
Dear Dr. Schlundt:
Negotiations are in progress for
settling the Tuck case, and I have every reason to
believe that they will be consummated prior to the
date set for trial - that is January 5th.
However, we are not disposed to settle
the Metz case, unless same can be disposed of for its
nuisance value only. Our present plan is to go to trial
in this instance.
As I previously wrote you the court has
authorized 8 re-examination of Mrs. Detz for the presence
of radioactive materials, and we have agreed upon January
2nd as the date for this examination. Mrs. Metz's counsel
have agreed that she will report to Dr. Flinn's office
in case she is able to do so - however, should she not be
able to make such a trip we will have to plan on collecting
the air at her home. We are arranging to have "rs. Metz
report to Dr. Flinn's office on January 2nd, and I am in
hopes that you will arrive in New York to have at least
time to check up the instruments and see that they are
working properly - as you realize it is not feasible for
me to attempt much in this direction. That still leaves
Saturday, the 3rd, for us to make tests in the event
that we encounter any difficulties on Friday.
I am endeavoring to have Dr. Lind available
for a witness at this trial.
This program should fit in very well with
your contemplated plan of attending the meeting in Toronto
on December 29th to 31st. You could easily reach N.Y. on
January 1st and beavailable first thing Friday morning.
In the event that Anna would like to come
on with you at this time, please be assured that we would

delighted to have her. I think she would enjoy the
trip - and shopping in New York right after the first of
the year usually offers many charms for the women folks.
