Dear. Mr. Markley:
Confirming our confersation over the *phone yesterday,
rolative to our conference with Dr. Humphries on the subject of settlement
of the Saxer case - I herewith give you Mrs. Ruth Saxer's address, which
is 19 Schuyler Terrace, E. Orange, M.J., 'phone Nassau 3211-M.
Dr. Humphries indicated to us, rather forcefully, that he
felt this case should be settled, and that if it was not it would be necessary
for him to advise her to file suit in order to protect her rights. Tie called
to his attention the fact that lrs. Stzer had been complaining and had had
medical attention for more than 2 years prior to our taking Testimony in
June 1930, which would probably bar her case on the Statute of Limitations.
lie indicated, however, that we were disposed to settle this case, and pointed
out to Dr. Humphries our present relations with the Insurance Companies, advis-
ing him that the burden of this case foll solely to the U.S.R.Corp. Further
that we were making every effort to settle legitimate cases insofar as our
ability vould permit, but that we had to proceed cautiously.
Dr. Humphries asked what amount we proposed to offer lirs.
Saxer, and we told him approximately $5000.00. He took the position that
Mrs. Saxer should receive not less than $8000.00, and he felt that any amount
less than this was inadequate to provide her quith the care which will be
required as her case progressed. We told him that we folt the amount high
in view of the fact that lrs. Saxer had not had legal counsel, and that/the case
could be settled such counsel would not be necessary, and proposed that
Mrs. Saxer discuss the subject of settlement with you.
lir. Lee and I have discussed the matter of taking this
matter
up
with Mrs. Saxer, and feel that at the preliminary conference it
would be best for you to conduct negotiations without our presence, and we
therefore, suggest that you communicate with lirs. Saxer and make an appoint-
ment that would suit your convenience.
