Gentlemen:
We have just been served with a bill of
complaint in Chancery of New Jersey in the above (and we
have acknowledged the subpoena to an swer since the matter
is in our charge - we understand Edwards, Smith & Dawson
are doing likewise) to enjoin us from pleading the statute
of limitations. We have twenty days within which to remove
this case to the Federal Court.
We shall discuss with Mr. Smith who
represents the New Amsterdam, the question of whether or
not it should be removed. We shall have copies made of
the bill and send them to you in due course. The law action
is on the United States calendar for Tuesday, January 3rd
and will be marked off for the term pending the prosecution
of this Chancery suit.
