In re: 1-C-556708C - Grace Seal (Shea) vs.
U.S.Radium Corporation.
Gentlemen:
We have your letter of Feb. 24th advising
us that Grace Seal (Shea) is making a claim against you
for alleged radium poisoning. We will give this matter
attention subject to the reservation of rights heretofore
expressed to you by both this Company and Messrs Collins
& Corbin, our attorneys. This Company feels that its
policy of insurance issued to you Nov. 4, 1919, does not
cover claims against you for radium poisoning, but we
are willing to leave the final determination of that
question pending the ultimate decision of litigation now
pending between us. You understand, of course, cooperating
with you in the handling of this particular case does not
in any way waive the question of policy coverage and is not
to be assumed by you as an assumption of the case as
properly falling within the terms of the policy.
Yours very truly,
BEE*MC
