Gentlemen:
I acknowledge receipt of Mr. Barker's letter of the
15th addressed to Mr. Smith and myself enclosing certified
copy of the death certificate and photostatic copy of the em-
ployment record of the plaintiff's intestate.
We were served on May 15th with a notice of
motion to permit our adversary to inspect and take a copy
of our books and records to the extent that the same indicate
the exact period of employment of the plaintiff's decedent
by the defendant and the earnings of the decedent and the
manner and method of their computation.
I understand from my telephonic talk with Mr. Barker
that the photostatic copy of the employment record is the com-
pany's entire record of employment and of wages and that I
may send this photostatic copy to our adversary as a compliance
with his notice of motion, so as to avoid an argument of same
in court. I further understand Mr. Barker will send me another
photostatic copy of the employment record.
