Dear Dr. Schlundt:
This is to confirm my telegram of Tuesday after-
noon stating that the LePorte case has been postponed until
the Fall Term of Court. We were very mich disappointed in
this postponement as we have spent weeks of time in preparation
and folt we were as well prepared as we ever would be.
We also appreciate that you have undoubtedly gone
to considerable inconvenience in arranging your schedule ao that
it would be possible for you to come to New York at the time
specified, and want to express to you our appreciation for your
endeavors in this direction.
The Judge who was to hear the case is a hard working
man, and he felt he could more ably render decision by letting the
matter go over until the Fall Term of Court, as he has a considerable
amount of work shead of him and stated it sould be impossible for him
to render decision before Fall, even if he heard the case at this time.
As soon as a definite date for trial has been set, we
shall
communicate with you and hope that your schedule will be such
that it will be possible for you to assist us at that time.
I an doubly sorry that the case is postponed, as I had
anticipated a visit with you during the next two weeks. fith my
