UNITED STATES DISTRICT COURT DISTRICT OF NEW JERSEY GRACE SHEA and WILLIAM SHEA, : Plaintiffs, : VS. : Actions at Law and in Equity. UNITED STATES RADIUM CORPORA- : TION, a corporation of the STIPULATION State of Delaware, : Defendent. : : It is hereby stipulated by and between Milton M. Unger, Esq., attorney for plaintiffs and Messrs. Edwards, Smith & Dawson and Messrs. Collins & Corbin, attorneys for the defendant in the above entitled matter, that the oral testimony of witnesses for the defendant, namely, Dr. Rollin H. Stevens and Dr. Ernest Albert Pohle, be taken in Chicago, Ill. at one P. M. (Daylight Saving Time) in the afternoon on Monday, May 21, 1934, at the office of Messrs. Follansbee, Shorey & Schupp, 137 S. La Salle Street, Chicago, Ill., be- fore Morr is Cohen, a Notary Public sitting as a Commissioner specially appointed by agreement of the parties for that purpose, said oral testimony as given to be taken down and reported stenographically by said Morris Cohen or any other stenographer duly appointed by him and sworn, three trans- cripts of said testimony to be subscribed and sworn to by the witnesses as well as said notary; one transcript of said testi- mony subscribed and sworn to, to be delivered to each firm of attorneys. Said testimony is taken de bene esse, that is to say, it is to be used on the trial in the event that the sa id witnesses are not produced at the trial. The plaintiffs are to have the right of eross examination of said witnesses.
