Dear Sirs:
I have a letter from Mr. Emmerglick,
counsel for the plaintiff in the above, wherein he
states that he will consent to an adjournment of the
final hearing of the equity suit until October 15th,
but only upon the express condition that it meets
with Judge Forman's approval, and second, that if for
any reason either Dr. Schlundt or Dr. Lind cannot be
present on the 15th, we will arrange to take their
testimony in advance, or else proceed with the case
without their testimony
In view of the fact that the matter has
been adjourned repeatedly, I am quite sure that Judge
Forman will impose such terms, and I am merely calling
them to your attention, so that they may be a matter
of record.
