My dear Mr. Barker:
Shortly before last Monday Mr. Emmerglick gave
us notice of an appearance before Judge Forman to ascertain
what part of the testimony the court deemed him to have written
out. The court felt that all of the testimony was important
and that unless he had all of it, he thought he might overlook
some points that might be important to both parties in arriving
at his decision.
The question then came up as to the expense. Mr.
Unger (who was present) endeavored to have the court require the
Radium Company to pay the cost of writing up the court's copy and
to have the court allow him to use the court's copy without
expense to him. Of course, this was objected to The court
finally said he could see no reason why he should depart from the
usual rule, to wit, that each party should bear one-half of the
stenographic cost.
The stenographer estimated the cost of writing the
testimony at $3,000.00, and said that the Radium Company would be
given credit for the testimony already written up and paid for
by it.
