Dear Mr. Lee Replying further to your letter of the 3rd in the above, please be advised that Mc. Lee Ingraham, Manager of the Aetna Life Insurance Company, requests me to write you stating that his company feels it isunder no obligation to provide any further defense of any kind in any one of these occupational disease cases, in view of the decisionof Judge Ackerson in United States Radium Corp. vs. Aetna, Globe, et al. He is willing to receive from time to time advices as to what is transpiring, if you care to send such information but it must be with the distinct understanding that there is a complete reservation of all rights of coverage and that the Aetna Life Insurance Company at this time disclaims any liability and further refuses to give any defense. Of course, if Judge Ackerson should be reversed by the Court of Appeals, and it should be held by that ourt that there is coverage, then from that point on the Aetna Life Insurance Company would be willing to give the matter further consideration.
