Dear Mr. Markley: This will acknowledge receipt of your letter of December 30th with reference to conference you had with Mr. Peer of Messrs. Peer & Mahr. We are in accord with your suggestion that we refuse to enter into any negotiations for settlement of this case. In view of Judge Forman's decision, it seems to me that we must assume that we are in rather a formidable position as far as our defense is concerned, and therefore should not consider paying out any further monies to former employees un- less an appeal is taken in the case and Judge Forman's opinion reversed. In any event, we have decided to fight this thing through to a finish, and we must "sti ek by our guns" in that direction. The question of Mr. Emmerglick associating himself with counsel for other plaintiffs in appealing the LaPorte decision is one which we must watch closely and definitely determine Mr. Emerglick's intentions or plans in that direction, before making a final decision as to agreeing to the suggestion of Judge Forman that Mr. Emnerglick be paid an honorarium.
