United States District Court District of New Jersey Ethelwyne Metz (nee Peer) and : Edward Metz, her husband : : : Plaintiffs : : VS. : Action at Law United States Radium Corporation : a corporation of the State of ORDER DISMISSING Delaware : COMPLAINT : De fendant. : A motion to dismiss the complaint in the above stated cause having come on to be heard pursuant to notice duly served, in the presence of the Attorneys of the defendant, no one appearing on the part of the plaintiff in opposition thereto, and it appearing to the court that no steps have been taken therein since September Term 1933. It is on this 23ndday of May 1936, ordered that the complaint be and 1t hereby is dismissed for failure to prosecute with costs to def endant Jorman Judge On motion of Collins - Corbin Defendant's attorneys.
