Lynn - Thanks for making time for the Crow Tribe. I am amazed by the
breadth of issues they have become embroiled in. I hope I can help them.
I believe I have briefly communicated with you re: the state of Maine's
request to take over all authority - state-wide, including on Indian land
under the Clean Water Act for National Pollutant Discharge Elimination
System (NPDES) permits. The Indian tribes in Maine are very much opposed
to
Maine being given this authority over their lands and waters. To my
knowledge, this has never happened before. Our tribal clients in Maine
heard
that Interior was right on the verge of issuing a 2nd opinion to the EPA
and
that said opinion (which had been verbally described to the tribes), was
fundamentally positive and incorporated a number of the arguments the
tribes
(including the Micmacs and Maliseets, who have a weaker position than do
the
Penobscot and Passamaquoddy) have made in hearings and meetings on this.
Such an opinion would have bolstered the tribes' arguments.
Now, for reasons that are hard to fathom, we are hearing that Interior has
done a 180 degree turn and suddenly decided not to issue this second,
beneficial, opinion. The rumor is that EPA has asked them not to issue it
and that EPA is being browbeaten by Maine Gov. Angus King. This runs
completely contrary to earlier commitments by EPA Regional Administrator
Mindy Lubber that she would not be politically intimidated by the governor
or Maine's Senators. This is also fundamentally contrary to every
discussion and consultation that has been taking place over the last few
months between the tribes and people at Interior and EPA.
